VI-25 Eugene Charter VII-28 <br /> (b) resolution of interest-impasse disputes; <br /> (c) as to employees who are employed in police or fire service, a <br /> binding award by a neutral third party resolving an interest-impasse <br /> dispute; <br /> (d) equal sharing of neutral third-party costs by parties to an <br /> interest-impasse dispute; <br /> (e) employee rights; <br /> (f) employer rights; and <br /> (g) procedural finality that does not obstruct funding of collective <br /> bargaining agreements. <br /> Section 26. Liability for Unauthorized Expenditures. <br /> (I) A city officer who participates in, advises, consents to, or allows any <br /> tax, assessment, or other money of the city to be diverted to any purpose other than the <br /> one for which it is assessed, collected, raised, or levied is guilty of malfeasance in office <br /> and removable from office therefor as provided by law. <br /> (2) Anyone holding, in good faith and for a valuable consideration, any <br /> void evidence of debt against the- city shall have the right of a personal action against <br /> any and all members of the council .or the members of any department of the city who <br /> voted fora roved of or directed its issuance. <br /> pP , <br /> (3) If any tax, assessment, or other money is diverted from the purpose <br /> for which it is assessed, collected, raised, or levied; or if any money is unlawfully used; <br /> or if any void evidence of debt is paid, any qualified elector or taxpayer of the city shall <br /> have the right of a civil action, in the name of the city, against any officer voting for, <br /> approving of, or in any way directing the diversion, unlawful use, or void payment, for <br /> the recovery of the amount, with interest, for the benefit of the city. <br /> <br /> ~I Chapter VII <br /> Ordinances <br /> Section 27. Ordaining Clause. The ordaining clause of an ordinance shall read: "The <br /> City of Eugene does ordain as follows:" <br /> Section 28. Adoption. <br /> (1) Except as subsection (3) of this section provides for reading by title or <br /> bill number only, and except as subsection (2) of this section provides for immediate <br /> adoption of emergency measures, an ordinance, before being finally adopted, shall be <br /> fully and distinctly read in open council meeting on two days. <br /> (2) Except as subsection (3) of this section provides for reading by title or <br /> -7- 01/01/97 <br /> <br />
