5 City of Eugene <br /> Human Resource and Risk Services Policies <br /> practicable, but the City cannot promise absolute confidentiality. If it is <br /> <br /> . ~ necessary to make the identity of the complainant known to others, the <br /> employee will be advised in advance. <br /> All discussions with employees about a complaint. will be held in private, <br /> away from the employee's immediate work area. Employees may <br /> request to have a representative present at any discussion. <br /> ~ A written record of the investigation will be made. The written complaint <br /> and the related investigative materials will be maintained in HRRS in a file <br /> separate from an employee's personnel file. No notations will be made in <br /> the complainant's personnel file. <br /> If after an investigation, it is determined that there is merit to the complaint, <br /> immediate and appropriate corrective action will be taken. Depending on <br /> the circumstances and the employee's overall work record, disciplinary <br /> action, up to and including termination, may be taken. <br /> Alternative Complaint Avenues <br /> If the employee making the complaint is dissatisfied with the decision or if <br /> he/she prefers, he/she can elect to file a complaint with the Oregon State <br /> Bureau of Labor and Industries or the Federal Equal Employment <br /> Opportunity Commission. <br /> This process is separate and apart from the grievance procedure under <br /> current collective bargaining agreements. <br /> Retaliation <br /> Any intimidation, coercion, discrimination or retaliation against an <br /> individual who files a complaint or who testifies, assists or participates in <br /> any manner in an investigation will not be tolerated. Employees should <br /> report retaliation immediately, using any of the avenues for .making a <br /> complaint described above. All complaints will be investigated <br /> according to the investigation procedure described above. <br /> Corrective action, including discipline or termination, will be taken where <br /> appropriate. <br /> Human Resource and Risk Services Revised:. 12/19/00 <br /> <br />
