Grant Agreement <br /> Project No: 99-446 <br /> other title restriction, restricting the use of the Property to those uses allowed under ORS <br /> 541.375(9). <br /> (4) The commitment of funds by the Board will be rescinded if transfer of fee simple title to <br /> OPRD has not occurred on or before October 2, 2000. <br /> (5) It is the intent of the Grantee that a plan for the long term management of the Property be <br /> developed by the OPRD for public park and habitat protection purposes, consistent with <br /> the Board's statutory mission. Further, it is the intent of the Grantee and the Board that <br /> development of the management plan shall occur in a manner consistent with terms set <br /> forth in a Memorandum of Agreement between the OPRD and the Board that is separate <br /> from this grant agreement. Use of the Property shall be consistent with the purposes <br /> specified in Grantee's grant application number Z99-446 submitted to the Board (Exhibit <br /> B). <br /> (6) The Grantee may, by written addendum to this agreement, with the written consent of the <br /> Executive Director of the Board, identify a third party eligible to receive funds made <br /> available by this grant agreement in order to expedite transfer of title to the Property to <br /> j OPRD according to the conditions established in this grant agreement. <br /> i <br /> i (7) Funds disbursed to Grantee by the Board under this grant award will be used only for <br /> "capital expenditures" as that term is defined in ORS 541.3 51(4) (Exhibit C). <br /> II _ <br /> (8) Grantee will provide written confirmation to the Board that the acquisition and use of the <br /> "r-ope~t3~b -OPT-~c~publ-ie-park-and-hab~at-prof-~c-tion purPo~~o~those <br /> purposes specified in Exhibit B, is compatible with and allowed by applicable provisions <br /> of the Tillamook County Comprehensive Plan and land use regulations. <br /> (9) These conditions shall continue in effect for the term of this agreement. <br /> <br /> i <br /> D. Effective Date; Term of Agreement <br /> <br /> I Tliis agreernerrt shall become effective upon execution by both parties.. Execution may be made <br /> by facsimile and in counterparts, with conforming originals provided to the Board within seven <br /> (7) days of the date of facsimile. This agreement shall remain in effect for a term of five (5) <br /> years from its effective date. <br /> E. Accounting for Funds Distributed <br /> The Grantee shall account for funds distributed by the Board using generally accepted <br /> accounting practices. The Grantee further agrees to make such accounting records available to <br /> the Board, the Oregon Secretary of State's Office, or their employees, agents, and independent <br /> contractors upon request. <br /> F. Amendments <br /> Any amendement to this agreement must be mutually agreed to in writing by both parties. <br /> 2 <br /> _ _ _ _ <br /> <br />
