Contracts & Agreements <br />No. 17608 <br />LOCAL AGENCY AGREEMENT <br />HfGH PRIORITY PROJECT <br />FERN RIDGE BIKE PATH <br />THIS AGREEMENT is made and entered into by and between THE STATE OF OREGON,. <br />acting by and through its Department of Transportation, hereinafter referred to as "State", <br />and THE CITY OF EUGENE, hereinafter referred to as "Agency". ti <br />RECITALS <br />1. By the authority. granted in ORS 190.110, 366:770, and 366.775; State may enter into <br />cooperative agreements with the counties,. cities, and units of local government for the <br />performance of work on certain types of improvement projects with the allocation of costs <br />on terms and conditions mutually agreeable to the contracting parties. <br />NOW THEREFORE, the. premises being in general. as stated in theforegoing recitals, it is <br />agreed by and between the parties`hereto as follows: <br />TERMS OF AGREEMENT <br />1. Under said provisions, Agency plans and proposes to extend the Fern Ridge Bike Path <br />from Terry Street to Greenhill Road, hereinafter referred to as "Project". The location of <br />the Project is approximately as shown on the sketch. map .attached hereto, marked Exhibit. <br />A, and by this reference made a part hereof. <br />2. The Project shall be conducted as a part of the Transportation Equity Act for the 21St <br />Century (TEA-21) High Priority Projects (Subtitle F, Section 117) and the Enhancement <br />Program under Title 23, United States Code, and the Oregon Action Ptan. The total <br />Project cost is estimated at .$2,600,000. The High Priority Program Federal Funds are <br />limited to $1,170,000, subject to annual obligation authority imposed by TEA-21 and the <br />.appropriation bills (see Exhibit B, attached hereto and by this reference made a part <br />hereof). The Federal pro-rata share funding for the High Priority Program funds is 80 <br />percent. Eligible costs will be reimbursed at 80 percent until the authorized High Priority <br />Program Federa( Funds limit is reached. The Enhancement Program funds are limited to <br />$937,000. The maximum allowable. Federal fund .pro-rata will be .used for the <br />Enhancement Program Federal Funds. <br />
