Exception to this paragraph: Should a union strike or labor disturbances <br /> occur during the time required for EWEB's performance of its obligations under this <br /> Agreement, EWEB will provide alternate means of meeting its obligations under this <br /> Agreement. If EWEB is unable to provide work crews, outside work forces, or other <br /> alternate means suitable and sufficient to properly prosecute. the Work within timelines <br /> established by this Agreement due to a union strike or labor disturbance, the City reserves <br /> the right to proceed with the Project. If the City proceeds with the Project and EWEB does <br /> not complete its Work on schedule under this Agreement, EWEB will be responsible to <br /> complete its Work using other means and methods which do not damage the completed <br /> Project pavement or cause delays to the Project. As approved by the City, EWEB may <br /> resume th <br /> e Work .when. it is able to rovide the ersonnel an <br /> p p d/or forces to meet its <br /> obligations under this Agreement. <br /> The Party shall, however, make all reasonable efforts to remove or eliminate such cause of <br /> delay or default and shall, upon the cessation of the cause, diligently pursue performance of <br /> its obli ations under this Contract. <br /> g <br /> Confidentially: To the extent possible under Oregon Public Records Law, the terms of this <br /> agreement will remain confidential between the parties.
