The public interest in considering this agreement has been <br /> to support the re-opening of West University Park for public use in a manner that maximizes the <br /> likelihood of positive use. Since July, the proposal has undergone public review and extensive internal <br /> review by several City departments. A preliminary review was conducted at the direction of the City <br /> Manager. Following a discussion of the results of this review, the Eugene City Council voted to direct <br /> staff to negotiate and execute a final agreement. <br /> The attached agreement describes the final, mutually-approved conditions of the proposed property <br /> exchange between the City of Eugene and Robert and Leslie Quinney. The. agreement has been <br /> reviewed and approved by the City Attorney and the affected City Departments. In general, the <br /> agreement obligates the City and Quinneys to convey the identified parcels of property, providing the <br /> conditions of the agreement are met. It furthermore specifies a range of other obligations for both <br /> parties, for example the amount of payment #o the City for the difference in property value, timing and <br /> scope of certain actions, design criteria for the housing project proposed by the Quinneys for their new <br /> . parcel, and a Right of First Refusal for the Quinneys to purchase the park property should it be sold by <br /> the City in the future. <br /> BACKGROUND INFORMATION <br /> West University Park has been closed since 1995. This closure was due to serious and constant <br /> negative activities occurring within the park. The abutting property owners to the east, the Quinneys, <br /> wish to redevelop their property, and advanced a proposal to reconfiguration ofboth properties for <br /> mutual benefit. <br /> The Quinneys have stated their intent to redevelop multifamily housing on their existing parcel, or on <br /> the re-configured parcel, depending on whether or not the City accepts their proposal. The <br /> reconfiguration benefits the Quinneys' housing project by allowing direct parking access off the alley, <br /> <br /> r <br /> <br />
