City of Eugene /State of Oregon -Dept of Transportation <br /> Jurisdictional Transfer Agreement No. 777 <br /> Unit A <br /> All land within the right of way boundaries of Pacific Highway West, State <br /> Highway No. 1 W, OR Route No. 126 Business (6th Avenue, 7th Avenueh <br /> Broadway, and Franklin Boule hard), beginning at MP 123.30 on 6 <br /> Avenue and MP 123.37 on 7 Avenue, said mile points being the <br /> intersection of the highway and easterly right of way line of Washington <br /> int bein the <br /> t rl to MP 125.48 said mile o <br /> Street. Thence runnin ease , <br /> 9 Y p 9 <br /> intersection of the highway with the westerly right of way line of Walnut <br /> Street and lying in Sections 31, 32, and 33, Township 17 South, Range 3 <br /> West, W.M., City of Eugene, Lane County, Oregon. <br /> 2. State hereby relinquishes all maintenance responsibilities for Unit A (except as <br /> assigned in a subsequent agreement as noted in Terms of Agreement, Paragraph <br /> 8), and City hereby accepts all maintenance responsibility for Unit A, upon execution <br /> of this Agreement. Upon completion of the transfer, State shall relinquish and City <br /> shall accept all repair responsibilities and liability for Unit. A. <br /> 3. State agrees that it will notify the Travel Information Council (TIC) of the transfer of <br /> jurisdiction when there are any TIC signs on such facility, in accordance with ORS <br /> 377.708. <br /> 4. State agrees to furnish City any maps, records, permits, and any other related data <br /> available that may be required to administer this section of Pacific Highway West. <br /> 5. Upon adoption of a Resolution by the OTC providing for elimination of Unit A, and <br /> acceptance and recording of a Jurisdictional Transfer Document, State shall forward <br /> to City an advance deposit with. City of $1,611,1.88 for the pavement overlay work to <br /> Unit A as defined in Terms of Agreement, Paragraph 2. <br /> 6. State's Project Manager for this project is Michael Spaeth, District 5 Manager, 644 A <br /> Street, Springfield, Oregon 97477, phone (541) 744-8080, or designee. <br /> CITY OBLIGATIONS <br /> 1. City, or its consultant, shall perform pavement overlay to Unit A as described in <br /> Terms of Agreement, Paragraph 2. Any costs that exceed $1,611,188 of State <br /> -funds shall be paid at City's expense. <br /> <br /> 2. City agrees to accept all of State's right, title and interest in Unit A; to accept <br /> jurisdiction and control over the property, and to maintain the property as a portion- <br /> of its city street system as long as needed for the service of persons living thereon <br /> or a community served thereby (including all traffic signals [except as designated in <br /> subsequent Agreement as identified in Terms of Agreement, Paragraph 8], signs, <br /> illumination, ramps, Bridge #07214A, and all things and appurtenances within the <br /> 4 <br /> <br />
