Jurisdictional Transfer No. 777 <br /> eliminate Unit A as a portion of the Pacific Highway West and the state highway system; that all <br /> right, title, and interest of the State of Oregon in Unit A shall be conveyed to the City; and that <br /> the Unit shall. be maintained by the City as a portion of its city street system as long as needed <br /> for the service of persons living thereon or for a community served thereby. <br /> THEREFORE, IT HAS BEEN RESOLVED BY THE OREGON TRANSPORTATION <br /> COMMISSION AS FOLLOWS: <br /> 1. The Washington Street (M.P. 123.30 on 6'h Avenue and M.P. 123.3,7 on 7~' Avenue) to <br /> Walnut Street (M.P. 125.48) Section of the Racific Highway West, State Highway No. <br /> 1 W (91 in Lane County, Oregon, is no longer needed by the State of Oregon as a <br /> portion of the state highway system. Said portion hereinafter referred to as Unit A has <br /> been duly eliminated as a portion of the Pacific Highway West and the state .highway <br /> system. All right, title, and interest of the State of Oregon in Unit A hereby passes to <br /> and vests in the City of Eugene as a portion of its city street system as long as needed <br /> for the service of persons living thereon or a community served thereby. <br /> Any right-of-way beirig conveyed in which state has any title shall be vested in City only. <br /> so long as used for public road purposes. If said right-of-way is no longer used for public <br /> road purposes, it shall automatically revert to State. Unit A is described as follows: <br /> Unit A <br /> All land within the right-of--way boundaries of Pacific <br /> Highway West, State Highway No. 1 W, OR Route No. 126 <br /> Business (6"' Avenue, 7 Avenue, Broadway, and Franklin <br /> . Boulevard), beginning at MP 123.30 on 6th Avenue and MP <br /> 123.37 on 7"' Avenue, said mile points being the inter- <br /> section of the highway and easterly right of way line of <br /> Washington Street. Thence running easterly to MP 125.48, <br /> said mile point being the intersection of the highway with <br /> the westerly right of way line of Walnut Street and lying in <br /> Sections 31, 32, and 33, Township 17 South, Range 3 <br /> West, W.M., City of Eugene, Lane County, Oregon. <br /> 2. -The property above described is transferred. subject to the rights of any utilities located <br /> within said property and further subject to the rights of the owners of said existing <br /> facilities if any there be, to operate, reconstruct, and maintain their utility facilities <br /> presently located within said property. <br /> 3. Because Unit A is either on the National Highway System (NHS) or was part of the <br /> federal aid primary system in existence on June 1, 1991, it continues to be subject to the <br /> requirements of 23 USC 131 and the Oregon Motorist Information Act, ORS 377.700 to <br /> 377.840 and 377.992, after transfer, and State retains authority to enforce those laws. <br /> In accordance with those laws, State is required to continue regulating outdoor <br /> <br /> Jurisdictional Transfer Document <br /> 8/22/06 <br /> <br /> 2 <br /> <br />
