Building B , <br /> Salem, Oregon 97301 <br /> RE: Jurisdictional Transfer, Pa~aHwy West, from Mile-Point 123.37 to 125.48 <br /> i Dear Mr. Scheick: <br /> Thanks for your letter dazed February 24, 2006, providing our office an opportunity to review aad <br /> comment on the Oregon Department of Transportation's (ODOT} intent to transfer jurisdictional <br /> control of a section of the OR 99/OR126B to the City of Eugene. <br /> You have provided an excellent review and analysis of the policies and criteria of the Oregon <br /> Highway Plan, as they relate to the City of Eugene's request for inter <br /> jurisdictional transfer of a <br /> section of OR 99/126B, from Mile Point 123.37 to 125.48. It has been noted that the City's interest <br /> in this segment of state highway is focused on local urban access and circulation, in contrast to the <br /> State's focus on through traffic. You have also stated that the transfer will reflect the appropriate. <br /> functional class of this facility, making local urban access and circulation as the priority. <br /> <br /> . We would like to bring the following for consideration in your processing of this transfer: <br /> • Inter <br /> jurisdictional transfers do not automatically change the federal functional <br /> classification. Federal functional classifications changes would have to be initiated by the <br /> Iocal jurisdiction through ODOT for Federal Highway Administration (FHWA) approval. <br /> • Federal funds, for projects on facilities under local control, would be requested by the local <br /> jurisdiction through ODOT, for FHWA approval, and must meet all the federal-aid <br /> requirements. <br /> • Any right-of-way acquisition or access control measures recorded with the land would <br /> remain in effect. <br /> • The requirements for maintaining effective control of outdoor advertising would remain in <br /> effect. <br /> • The requirement to maintain and operate this corridor to the standards appropriate to protect. <br /> ..past (and. futttre) federal investments remains in effect. <br /> 10 <br /> <br />
