Contracts & Agreements <br /> No. 23,076 <br /> City of Eugene Contract 2006-00222 <br /> LOCAL AGENCY AGREEMENT <br /> SURFACE TRANSPORTATION PROGRAM -URBAN <br /> Chad Drive: Old Coburg Road -North Game Farm Road <br /> Amendment No. 1 <br /> The State of Oregon, acting by and .through its Department of Transportation, <br /> hereinafter referred to as State, and the CITY OF EUGENE, acting by and through its <br /> elected officials hereinafter referred to as "Agency," entered into an Agreement on <br /> February 14, 2006. Said Agreement covers the extension of Chad Drive to connect with <br /> North Game Farm Road. <br /> It has now been determined by State and Agency that the Agreement referenced above, <br /> although remaining in full force and effect, shall be amended to .include right of way <br /> services. <br /> Para ra h 1 <br /> of S ecial Provision <br /> g p p s, Page 5, which reads. <br /> 1. Agency, or its consultant shall, as a federal-aid participating preliminary <br /> engineering function, conduct the necessary field surveys, environmental studies, <br /> traffic investigations, foundation explorations, and hydraulic studies, identify and <br /> obtain all required permits, assist State with acquisition of necessary right of way <br /> ,and/or easements, and perform all preliminary engineering and design work <br /> required to produce final plans, preliminary/final specifications and cost <br /> estimates. <br /> Shal( be deleted in its entirety and amended to read: <br /> 1. Agency,. or .its consultant shall, as a federal-aid participating preliminary <br /> engineering function, conduct the necessary field surveys, environmental studies, <br /> traffic investigations, foundation explorations, and hydraulic studies,. identify and <br /> obtain all required permits, acquire the necessary right of way and/or easements <br /> as shown in the attached Exhibit B, by reference .made. a part hereof, and <br /> perform all preliminary engineering and design work required to produce final <br /> plans, preliminary/final specifications and cost estimates. <br /> This amendment may be executed in several .counterparts (facsimile or otherwise) all of <br /> which when taken together shall constitute one agreement binding on all parties, <br /> notwithstanding that all parties are not signatories to the same counterpart. Each copy <br /> of-this amendment so executed shall constitute an original. <br /> Except as expressly amended above, all other terms and conditions of the Agreernent <br /> are still in full force and effect.
