(City), as grantor, <br /> and the State of Oregon, acting by and through its Oregon Watershed Enhancement <br /> Board (OWEB), an agency of the State of Oregon, as holder. <br /> RECITALS: <br /> <br /> ~ A. OWEB granted $305,000 from its Watershed Improvement Grant Fund (the <br /> "Funds") to the City for payment of part of the cost of acquiring that certain real property <br /> known as the "Lee tract" in Lane County, Oregon described in the attached Exhibit A <br /> (the "Property") pursuant to Grant Agreement No. 201-613 (the "Grant Agreement"). <br /> The City is a party to an agreement among The Nature Conservancy, the Bureau of Land <br /> Management, Lane County, U.S. Fish and Wildlife Service, Army Corps of Engineers <br /> and Oregon Youth Conservation Corps called the West Eugene Wetlands Partnership. <br /> The Partnership seeks to acquire, protect and restore wetlands and associated upland <br /> habitat; <br /> B. City used the OWEB grant funds to acquire the Property and is now the sole <br /> e Pro ert in fee sim le sub'ect to a conservation easement held b the <br /> owner of th p y p ~ Y <br /> Bureau of Land Management; <br /> C. ORS 541.375(9) requires that real property acquired with funds from the <br /> Watershed Improvement Grant Fund be used for the purposes specified under section 4b, <br /> Article XV of the Oregon Constitution, described iri Exhibit B; <br /> D. The purpose of this conservation easement is to ensure that the Property will <br /> continue to be used for the purposes specified under section 4b, Article XV of the Oregon <br /> Constitution, in satisfaction of the requirements of ORS 541.375(9); <br /> E. OWEB has held one or more public hearings on the acquisition of this <br /> conservation easement, and has given notice of such hearings in accordance with ORS <br /> 271.735; and <br /> F.
