AMENDMENT NO.One TO <br /> City of Eugene Contract No. 2006 - 00210 <br /> This Amendment is made to the Developer Agreement For Construction of Public Improvement <br /> .Contract dated November 9, 2005, between the City of Eugene (City) andEast Ridge <br /> <br /> ~j Development, LLC (Contractor). <br /> City and Contractor mutually agreeto amend and extend the contract referenced above as <br /> follows: <br /> ~ 1) Amend Exhibit C to re-bring the fee structure up to date. Fees will reflect actual City <br /> costs incurred for City of Eugene engineering services, determined in accordance with <br /> the City's Public Works Engineering Services Fee Schedule in effect at the time the <br /> services are rendered. Fees will be billed and payable monthly, with final payment due <br /> ~ prior to City's final acceptance of the completed improvements. Hourly ratesand certain <br /> flat rate fees are set by administrative order at the start of each fiscal year to recover the <br /> full cost of engineering services, including all overhead costs (as required by Section <br /> 7.1.30(1) of the Eugene City Code). <br /> 2) Amend the definition of "Administrative Costs" in section 1 (b) of the Developer <br /> Agreement to delete the words "effective July 19, 2005" <br /> 3) Extend contract completion date until November 17, 2007 to match theamended <br /> termination date on the intergovernmental grant agreement between Lane County and <br /> the City of Eugene for Project #0870-5 (City of Eugene Contract #200400219), as <br /> amended July 7, 2005 and January 22, 2007. <br /> <br /> a <br /> All other terms and conditions of this contract remain in full force and effect. <br /> CITY OF EUGENE CONTRACT <br /> t ~i <br /> N"'~ <br /> nnis M.
