City of Eugene / ODOT <br /> Agreement No. 21,334 <br /> <br /> i <br /> ~ - <br /> and writings of each party that are pertinent to this Agreement to perform <br /> ' examinations and audits and make excerpts and transcripts. Both parties shall retain <br /> ' and keep al! files and records for a minimum of three years foltowiing termination of the <br /> agreement. <br /> i <br /> 5.4Compliance with Laws. Both patties shalt comply with all federal,~state and local laws, <br /> regulations, executive orders ~ and ordinances applicable to the work under .this <br /> Agreement, including, without limitation, the provisions of OR$ 279.312, 279.394, <br /> 279.316, 279.320, and 279.555, which herby are incorporated by this reference. <br /> Without limiting the generality of the foregoing, both parties expressly agree to comply- <br /> , with: (i) T'itie VI of Civil Rights Act of 1964; (i~ Sections = V and 504 of the <br /> Rehabilitation Act of 1973; (iii) the Americans with Disabilities A of 1990 and ORS <br /> 659A.142; (iv) all regulations and adm~rnstrative rules establ~s~ed ursuant to the <br /> P <br /> foregoing laws;. and (v) alt other applicable requirements of fegeral .and state civil <br /> rights and rehabilitation statutes, rules and regulations. <br /> 5.5 Due Authorization. Each party represents that this Agreement hays been signed by its <br /> du authoriz ' <br /> ty ed representative. C' re resents that this r ent is si ne <br /> . ~Y p ~9 g d by. <br /> personnel who have been authorized to do so by the City Councii,~or desi nee. <br /> 9 <br /> 5.6 Workers Compensation. All employers that employ subject worigers who work under <br /> this Agreement in the State of Oregon shall comply with ORS 656017 and provide the <br /> required Workers' Compensation coverage unless such employe are exempt under <br /> ORS 65.126. Ail parties shall ensure that each of its subcontr ctors complies with <br /> these requirements. <br /> 5.7 Termination: <br /> 5.7.1 By Mutual Consent. This Agreement may be terminated by mutual written consent . <br /> of both parties. - <br /> 5.7.2 By ODOT.
