'I City of Eugene / ODOT <br /> Agreement No. 21,334 <br /> 3.1.1 Prior to pertorming any work on the environmen#a! mitigation bite within the ODOT <br /> Property located on Tax Lot(s) 203 and 204 of T.17S, R. 4W, Sec. 34 (also known <br /> <br /> I~ as <br /> the Marfinson Property), Cray shall contact ODOT's Region 2 Environmental <br /> Wetland Specialist at 503) 986-2817, describe the specific ~ ork proposed to be <br /> done, and obtain approval. <br /> ~~v~ F~~~ <br /> 3.1..2 City shall use City's normal standards and practices to pertornn the work described <br /> in this subsection 3.1 and shall perform all such work in compliance with all <br /> applicable federal, state and local laws and regulations, indukling City. of Eugene <br /> regulations. <br /> 3.1.3 City shall have the discretionary right, but not the obligation, to enter onto the <br /> . ODOT Property to remove any garbage, trash, abandoned vehicle, animal carcass, <br /> illegal homesite or similar unsanitary condition on the ODOT Property. City shall <br /> . consult with ODOT's Project Manager to describe proposed work and obtain <br /> approval prior to commencing work under this sub-subsection 3~ 1.3. <br /> 3.2 Reimbursement Billing. On a monthly basis, City shall send to ODOT's project <br /> manager invoices for actual costs incurred by City for work performed under this <br /> .Agreement. - <br /> 3.3 Limitation on Reimbursemen#. City agrees that its right to receiv reimbursement for <br /> - work performed under subsection 3.1 shall not exceed $12,000 pe fiscal year. <br /> 3.4 Subcontractors. If City employs a contractor to perform th work under this <br /> Agreement, City shall require contractor to obtain and keep in eff during the term <br /> of the contract, Comprehensive or Commerdal General Liability'lnsurance covering - <br /> bodily injury and property damage. .This insurance shall inde~de personal injury <br /> saver e, contractual Gabil' covers a for the indemn' <br /> ag rty g rty provided under this <br /> - agree~neni-and products/completed operations liability. Combined single limit per <br /> occurrence shall not be less that $1,000,000 or the equivalent.
