Contracts 8~ Agreements <br /> No. 21,334 <br /> MAINTENANCE AGREEMENT <br /> THiS AGREEMENT is made and entered into by and between THE STATE OF OREGON, <br /> acting by and through its Department of Transportation, hereinafter re~en'ed to as "ODOT", <br /> and THE CITY OF EUGENE, hereinafter referred to as "City." <br /> RECITALS <br /> 1. By the authority granted in ORS 190.110, 366.770, and 366.775, (DOT may enter-into <br /> cooperative agreements with the counties, cities and units of local jgovemments for the <br /> <br /> i, performance of work on certain types of maintenance or improvemjent projects with the <br /> .allocation of costs on terms and conditions mutually agreeable to the contracting <br /> parties. <br /> 2. This Agreement is intended to provide a cooperative .agreement between ODOT and <br /> City for the management of vegetation problems and the elimination of possible <br /> nuisance conditions that may develop on certain vacant real prop owned by ODOT <br /> within the urban growth boundaries of City and more particularly dscribed in Exhibit A <br /> and hereinafter refen-ed to as the "ODOT Property'. <br /> NOW THEREFORE, the premises being in general as stated in the foregoing RECITALS, <br /> it is agreed by and between the parties hereto as follows: <br /> TERMS OF AGREEMENT <br /> .1. TERM. ~ The term of this Agreement shalt begin on the date all required signatures are <br /> obtained and shall be in effect for a period of two years. This ~4greement may be <br /> extended at that time by mutual consent of both parties in the fdrm of an amended <br /> agreement. <br /> f <br /> 2. AMENDMENT. This Agreement may be modified by mutual conserjt of both parties <br /> and upon execution of amendments to #his Agreement stating said hnodifications. <br /> 3. CITY RIGHTS AND OBLIGATIONS <br /> 3.1 Services.
