City of E~ ~e Contract: 2004-00220 <br /> ' CAPP Agreement <br /> Wayne Morse Federal Courthouse <br /> l <br /> I <br /> First Phase <br /> Trans ortation Im rover e is <br /> n n <br /> p p <br /> - Project# 0870-8 <br /> THIS AGREEMENT entered into by and between Lane County, a political subdivision of the State <br /> of Oregon, hereinafter referred to as COUNTY, and the City of Eugene, a municipal corporation of the <br /> State of Oregon, hereinafter referred to as CITY. <br /> I <br /> RECITALS <br /> ~ 1. In accordance with Lane Manual 21.124 and by the authority granted in ORS 190.010 and the <br /> Lane County Home Rule Charter, units of local government may enter into agreements for the <br /> performance of any and all functions and activities that a party to the agreements, its officers or agents, <br /> i <br /> have authority to perform; and <br /> 2. ORS 373.260(1)(a) provides that counties and cities may enter into intergovernmental <br /> agreements for the construction, improvement or repair of, and the acquisition of right-of--way for any- <br /> county road or city street within the corporate limits of the city; and <br /> 3. Through approval of Board Order No. 03-6-11-1, the FY 03/04 through FY 07/08 Capital <br /> Improvement Program was amended to include the initial transportation improvements associated with <br /> the Wayne Morse Federal Courthouse. The Lane County Board of Commissioners has allocated <br /> $325,000 to the City of Eugene under the Capital Project Partnership Program for eligible project costs. <br /> Construction is planned for FY 03/04. <br /> 4. CITY has proposed the following under Phase 1 of transportation improvements for which this <br /> agreement is intended: <br /> • Construction of a new Arterial link running from the Hilyard and Broadway intersection to 6th . <br /> Avenue at High Street. <br /> • New Traffic Signal at the intersection of Mill Street and 8th Avenue. <br /> • Reconstruction of 8th Avenue from Mill Street to railroad crossing. <br /> • Reconstruction and partial realignment of Ferry Street from Broadway to 8th Avenue. <br /> • One block extension of Ferry Street from 8th Avenue to the new Arterial segment parallel to the <br /> <br /> j railroad tracks. <br /> The diagram labeled EXHIBIT A shows the proposed improvements as is made a part hereof. <br /> AGREEMENTS <br /> COUNTY AGREES TO: <br /> 1. COUNTY, per Board Order No. 03-6-11-1, grants CITY up to $325,000 to be used for Road <br /> Fund eligible expenditures allowable under the Oregon Constitution, Article IX, Section 3a for Phase 1 of <br /> the transportation improvements associated with the Wayne Morse Federal Courthouse. <br /> 2. COUNTY shall transfer road funds to CITY upon receipt of invoices detailing eligible project <br /> costs in accordance with all pertinent laws and regulations required of and by COUNTY and upon <br /> satisfaction of all agreement terms. <br /> CITY AGREES TO: <br /> <br />
