3 <br /> 3 <br /> INTERGOVERNMENTAL AGREEMENT <br /> AMENDMENT NO. 1 <br /> PW#: 03102002 <br /> City of Eugene Contract 2004-00220 <br /> AGREEMENT: Wayne Morse Federal Courthouse DATE: May 26, 2004 <br /> Transportation Improvements -.Project#: 0870-8 <br /> AGENCY: City of Eugene CONTRACT DATE: 11-17-03 <br /> ~ ADDRESS: 858 Pearl Street, Suite 300 PREVIOUS AMEND DATE: None <br /> Eugene, OR 97401 <br /> i <br /> j WHEREAS, per Board Order 03-6-11-1, Lane County and the City of Eugene entered into an agreement <br /> on November 17, 2003 for the Wayne Morse Courthouse Transportation Improvements; and <br /> I <br /> WHEREAS, per Board Order 04-5-5-7, the Board of County Commissioners adopted the Public Works <br /> Five-Year Capital Improvement Program (CIP) for FY 04/05 - FY 08/09; and <br /> III WHEREAS, as part of the FY 04/05 - FY 08/09 CIP adoption, the Board granted an additional $1.275 <br /> million for the federal courthouse transportation improvements project. <br /> NOW THEREFORE, the agreement is amended as outlined below. <br /> ALL OTHER TERMS AND CONDITIONS SHALL REMAIN IN FULL FORCE AND EFFECT. <br /> ******************x <br /> RECITALS, No. 4, page 1, which now reads: <br /> 4. CITY has proposed the following under Phase 1 of transportation improvements for which this <br /> agreement is intended: <br /> <br /> j Construction of a new Arterial link running from the Hilyard and Broadway intersection to 6th <br /> Avenue at High Street. <br /> • New Traffic Signal at the intersection of Mill Street and 8th Avenue. <br /> • Reconstruction of 8th Avenue from Mill Street to railroad crossing. <br /> • Reconstruction and partial realignment of Ferry Street from Broadway to 8th Avenue. <br /> • One block extension of Ferry Street from 8th Avenue to the new Arterial segment parallel to the <br /> railroad tracks. <br /> Shall be amended to read: <br /> 4.
