220 <br /> 221 H. Dual Payment. The Recipient shall not be compensated for or receive any other form of dual payment for work <br /> 222 performed under this Agreement from any agency of the State of Oregon or the United States of America or any <br /> j 223 other party. <br /> i 224 <br /> 225 I. Compliance with Workers' Compensation. The Recipient shall require that the contractor, its subcontractors, <br /> 226 if any, and all employers working under this Cooperative Agreement are subject employers under the Oregon <br /> 227 Workers' Compensation Law and shall comply with ORS 656.017, which requires them to provide workers' <br /> 228 compensation coverage for all their subject workers. <br /> 229 <br /> 230 J. Affirmative Action. The Recipient must take affirmative steps to utilize small business and minority-owned <br /> 231 business sources of supplies, equipment, constructions, and services. Affirmative steps shall include the following: <br /> 232 <br /> 233 1. Including qualified small and minority business on solicitation lists. <br /> 234 2. Assuring that small and minority businesses are solicited whenever they are potential sources. <br /> 235 3. When economically feasible, dividing total requirements into smaller tasks or quantities so as to permit <br /> 236 maximum small and minority business participation. <br /> 237 4. Where the requirement pemrits, establishing delivery schedules which will encourage participation by small <br /> 238 and minority business. <br /> 239 5. Using the services and assistance of the Small Business Administration and the Minority Business <br /> 240 Development Agency of the Department of Commerce is required. <br /> 241 6. Additionally, the Recipient shall take similar appropriate affirmative action in support of women's business <br /> i 242 enterprises. <br /> 243 7. Also, the Recipient is encouraged to procure goods and services from labor surplus areas. <br /> 244 <br /> 245 K. Compliance with Applicable Law. The Recipient shall comply with all federal, state, and local laws and <br /> 246 ordinances applicable to the work to be done under this Agreement. <br /> 247 <br /> 248 L. Attorney Fees. In the event a lawsuit of any kind is instituted on behalf of the State of Oregon to collect any. <br /> 249 payment due under this agreement, or to obtain performance of any kind under this agreement, the Recipient, <br /> 250 .agrees to pay such additional sums as the court may adjudge for reasonable attorney fees and to pay all costs <br /> 251 and disbursements incurred therein. <br /> 252 <br /> 253 M. Payments by the Recipient. The Recipient agrees to: <br /> j 254 <br /> 255 1. Make payment promptly as due to all persons supplying labor or materials for the Project; <br /> 256 2. Pay all contributions or amounts due to the State Industrial Accident Fund on' behalf of the Recipient or any <br /> 257 of its contractors for liability incurred in the performance of this Agreement; and <br /> 258 3. Not permit any lien or claim to be filed or prosecuted against the State of Oregon, the Department, or the <br /> 259 Recipient as a result of any labor or material furnished for the Project. <br /> 260 <br /> 261 N. Compliance with Workers' Compensation. The Recipient shall require that the contractor, its subcontractors,. <br /> 262 if any, and all employers working under this Cooperative Agreement are subject employers under the Oregon <br /> 263 Workers' Compensation Law and shall comply with ORS 656.017, which requires them to provide workers' <br /> 264 compensation coverage for all their subject workers. <br /> 265 <br /> <br /> i 266 O. Nondiscrimination. The Recipient assures that the program supported by the fmancial assistance will be <br /> ' 267 conducted in compliance with all applicable state civil rights and rehabilitation laws and with Title VI of the Civil <br /> 268 _ Rights Act_of 1964 (P.L. 878-3.52),, as amended 42 USC 2000d ,and the re urrements ' osed_b the re atrons <br /> 26~ . of the Department of Commerce (15 CFR Part 8) issued pursuant to that title. In accordance therewith, no person in <br /> 270 the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied <br /> 271 the benefits of, or be otherwise subjected to discrimination under any program or activity for which the Recipient <br /> 272 receives federal financial assistance and will immediately take any measures necessary to effectuate this agreement. <br /> 273 This assurance is consistent with the executed "Assurances" of the application. <br /> 274 <br /> 275 <br /> 276 <br /> 5 <br /> _ _ <br /> _ _ _ <br /> <br />
