x ~ ~ Intergovernmental Agreement For WILL-HI STREET IMPROVEMENTS THIS INTERGOVET~NMENTAL AGREEMENT (this "Agreement") is made as of the 2 day of Apri 1 , 2002 between the Bethel School District ("District") and the City of Eugene, ("Eugene"), each party being a unit of local government. RECITALS 1. The District's property abuts the northern edge of all of that ortion of the ublic P P right of way for Will-Hi Street existing east of Echo Hollow Road (the "Street") within the City . it of Eu ene Ore on. 1 g ~ g 2. The southern portion of the public right of way for the Street is comprised of a thirty-foot-wide strip dedicated as a public way by Echo Hollow Pazk and the Echo Hollow Pazk 1~ Addition. The northern portion of the public right of way for the Street is athirty-foot-wide strip dedicated as a public way by the District. 3. The Street is currently improved as acounty-standard asphalt mat -street with ditches. 4. The District wishes the Street to be improved to comply with City standards for public streets, and is willing to pay for all costs of the Project that would normally be assessed ainst benefited roe if th ag p p rty e project were undertaken as a local unprovement project under the conditions set forth herein. 5. The District board of directors passed resolution number 57 on January 14, 2002 o agreeing to pay 100 /o of the landowner costs associated with the Willlu Street unprovements by the City of Eugene. 6. The City has agreed to design, construct and administer the Project, as provided herein. 7. The District has requested that the City schedule construction activities with the goal of completing the Project prior to the commencement of the 2003 school year. 8. ORS 190.010 authorizes units of government to enter into agreements for the joint performance of any or all. functions and activities that either party to the agreement has the authority to perform.
