x <br /> ~ ~ <br /> Intergovernmental Agreement <br /> For <br /> WILL-HI STREET IMPROVEMENTS <br /> THIS INTERGOVET~NMENTAL AGREEMENT (this "Agreement") is made as of <br /> the 2 day of Apri 1 , 2002 between the Bethel School District ("District") and <br /> the City of Eugene, ("Eugene"), each party being a unit of local government. <br /> RECITALS <br /> 1. The District's property abuts the northern edge of all of that ortion of the ublic <br /> P P <br /> right of way for Will-Hi Street existing east of Echo Hollow Road (the "Street") within the City . <br /> it of Eu ene Ore on. <br /> <br /> 1 g ~ g <br /> 2. The southern portion of the public right of way for the Street is comprised of a <br /> thirty-foot-wide strip dedicated as a public way by Echo Hollow Pazk and the Echo Hollow Pazk <br /> 1~ Addition. The northern portion of the public right of way for the Street is athirty-foot-wide <br /> strip dedicated as a public way by the District. <br /> 3. The Street is currently improved as acounty-standard asphalt mat -street with <br /> ditches. <br /> 4. The District wishes the Street to be improved to comply with City standards for <br /> public streets, and is willing to pay for all costs of the Project that would normally be assessed <br /> ainst benefited roe if th <br /> ag p p rty e project were undertaken as a local unprovement project under <br /> the conditions set forth herein. <br /> 5. The District board of directors passed resolution number 57 on January 14, 2002 <br /> o <br /> agreeing to pay 100 /o of the landowner costs associated with the Willlu Street unprovements by <br /> the City of Eugene. <br /> 6. The City has agreed to design, construct and administer the Project, as provided <br /> herein. <br /> 7. The District has requested that the City schedule construction activities with the <br /> goal of completing the Project prior to the commencement of the 2003 school year. <br /> 8. ORS 190.010 authorizes units of government to enter into agreements for the joint <br /> performance of any or all. functions and activities that either party to the agreement has the <br /> authority to perform.
