,~pO~ -Or/3 <br /> INTERGOVERNMENTAL AGREEMENT <br /> THIS AGREEMENT entered into by and between Lane County, a political subdivision of <br /> ' the State of Oregon, hereinafter referred to as COUNTY, and the City of Eugene, a municipal <br /> corporation of the State of Oregon, hereinafter referred to as CITY. <br /> RECITALS <br /> 1. ORS 190:010 and the Lane County Home Rule Charter provide that units of local <br /> government may enter into. agreements for the performance of any and all functions and <br /> activities that a party to the agreements, its officers or agents, have authority to perform; and <br /> 2. The Lane County Home Rule Charter and ORS 373 provides that COUNTY may <br /> enter into cooperative agreements with. CITY in the acquisition of right-of-way, improvement, <br /> and construction or maintenance of streets for the benefit of the public; and <br /> I <br /> 3. School District #52 will construct a new school near the intersection of Royal Avenue <br /> and Terry Street. Royal Avenue (a county road) will be used as an access street for the new <br /> school. CITY will improve the intersection of Royal Avenue and Terry Street (and approximately <br /> <br /> j 1,072 feet of Royal Avenue to the west) to urban standards to facilitate school access traffic; <br /> and <br /> 4. Through Board Order No. 01-10-31-2, an intergovernmental agreement between <br /> COUNTY and CITY has been authorized by the Board that assig s responsibility to CITY and <br /> COUNTY respectively; and <br /> 5. The parties agree that the CITY and COUNTY agreement will be based on the terms <br /> and conditions set forth herein: <br /> AGREEMENTS ' <br /> CITY AGREES TO: <br /> 6. Request formal surrender of the following section of Royal Avenue upon agreement <br /> .execution for the purpose of establishing it as a legal .city street: <br /> Beginning at a point on Royal Avenue which is the westerly end point of the <br /> City of Eugene jurisdiction of Royal Avenue (MP 2.261) also described as <br /> the west line of Section 21 (and its southerly extension) of T17S, R04W. <br /> Then westerly a distance of approximately 1, 072 feet,. more or less (MP <br /> . 2.451) to the west line and its southerly extension of Tax lot 3600 of <br /> assessor's map 170420. <br /> 7. Invoice COUNTY for no more than one-half of the construction costs incurred by <br /> CITY improving the above-described section of Royal Avenue to urban standards, up to the not- <br /> to-exceed amount of $225,000. Improving this section of Royal Avenue will hereinafter be <br /> referred to as PROJECT. Project costs eligible for COUNTY funding are limited to road-related <br /> items permitted by the Oregon Constitution. <br /> 8. Perform operational maintenance on the above-described section of Royal Avenue <br /> until its establishment as a legal city street.
