5.2.3 If the estimated Project Cost exceeds the sum of $301,000, the City will <br /> suspend further activity, and the District will immediately seek approval from the School <br /> Board for additional funding to complete the Project. <br /> 5.2.3.1 If the School Boazd authorizes full funding of the Project; the <br /> District shall provide the City with a certified copy of the minutes of the School <br /> Board's approval and a notice to proceed with the Project; <br /> 5.2.3.2 If the School Board refuses to increase the amount of funding for <br /> the Project, then either of the City or the District may cancel the Project and <br /> terminate this Agreement. <br /> 5.2.4 Notwithstanding the foregoing, the City will not be obligated to construct <br /> the Project after the expiration of any construction bid or proposal unless the City. is <br /> reimbursed for the costs of conducting a new solicitation. <br /> 5.3 Additional Ci Work. The City shall be solely responsible for all costs related to <br /> the engineering, design and construction of Additional City Work. <br /> <br /> i <br /> 5.4 Method of Reimbursement. The District shall reimburse the City not less than <br /> thirty (30) days after receipt of the City's invoice, following the earlier to occur of (i) the <br /> completion of the Project and all Additional District Work, or (ii) the date of termination of the <br /> Agreement. <br /> SECTION 6. Obligations of City. <br /> 6.1 The City will complete all necessary surveys, and provide all engineering and <br /> design services for the Project and any Additional Work, prepare construction plans and <br /> specifications, and solicit offers from contractors all in compliance with all applicable public <br /> contracting laws. <br /> 6.2 City agrees to construct the Project in compliance with all applicable laws and <br /> <br /> ' regulations, subject to the condition that City shall not be obligated to commence or complete <br /> construction unless District shall be obligated to reimburse City for costs of the Project. <br /> 6.3 City will not assess or levy any assessment for recovery of costs of the Project, to <br /> the extent that all of the Project Cost and the costs of Additional District Work are reimbursed by <br /> the District as provided herein.. <br /> IntergovernmentaTRgreement - 4 <br /> <br />
