GUUL-UUL44 <br /> a ~?V <br /> Intergovernmental Agreement <br /> For <br /> WILL-III STREET IMPROVEMENTS <br /> THIS INTERGOVERNMENTAL AGREEMENT (this "Agreement") is made as of <br /> the 2 da of Aril 2002 between the Bethel School District "District" and <br /> y a ( ) <br /> the City of Eugene, ("Eugene"), eachparty being a unit of local government. <br /> RECITALS <br /> 1. The District's property abuts the northern edge of all of that portion of the public <br /> -right of way for Will-Hi Street existing east of Echo Hollow Road (the "Street") within the City . <br /> <br /> I of Eugene, Oregon. <br /> 2. .The southern portion of the public right of way for the Street is comprised of a <br /> thirty-foot-wide strip dedicated as a public way by Echo Hollow Park and the Echo Hollow Park <br /> 1st Addition. The northern portion of the public right of way for the Street is athirty-foot-wide <br /> strip dedicated as a public way by the District. <br /> 3. The Street is currently improved as acounty-standard asphalt mat street with <br /> ditches. <br /> 4. The District wishes the Street to be improved to comply with City standards for <br /> public streets, and is willing to pay for all costs of the Project that would normally be assessed <br /> against benefited properly if the project were undertaken as a local improvement project under <br /> the conditions set forth herein. <br /> 5. The District board of directors passed resolution number 57 on January 14, 2002 <br /> a eein to a 100% of the landowner costs associated with the Willhi Street im rovements b <br /> g P Y <br /> P Y <br /> the City of Eugene. <br /> 6. The City has agreed to design, construct and administer the Project, as provided <br /> herein. <br /> 7. The District has requested that the City schedule construction activities with the <br /> goal of completing the Project prior to the commencement of the 2003 school year. <br /> 8.
