GUUL-UUL44 a ~?V Intergovernmental Agreement For WILL-III STREET IMPROVEMENTS THIS INTERGOVERNMENTAL AGREEMENT (this "Agreement") is made as of the 2 da of Aril 2002 between the Bethel School District "District" and y a ( ) the City of Eugene, ("Eugene"), eachparty being a unit of local government. RECITALS 1. The District's property abuts the northern edge of all of that portion of the public -right of way for Will-Hi Street existing east of Echo Hollow Road (the "Street") within the City . I of Eugene, Oregon. 2. .The southern portion of the public right of way for the Street is comprised of a thirty-foot-wide strip dedicated as a public way by Echo Hollow Park and the Echo Hollow Park 1st Addition. The northern portion of the public right of way for the Street is athirty-foot-wide strip dedicated as a public way by the District. 3. The Street is currently improved as acounty-standard asphalt mat street with ditches. 4. The District wishes the Street to be improved to comply with City standards for public streets, and is willing to pay for all costs of the Project that would normally be assessed against benefited properly if the project were undertaken as a local improvement project under the conditions set forth herein. 5. The District board of directors passed resolution number 57 on January 14, 2002 a eein to a 100% of the landowner costs associated with the Willhi Street im rovements b g P Y P Y the City of Eugene. 6. The City has agreed to design, construct and administer the Project, as provided herein. 7. The District has requested that the City schedule construction activities with the goal of completing the Project prior to the commencement of the 2003 school year. 8. ORS 190.010 authorizes units of government to enter into agreements for the joint performance of any or alL functions and activities that either party to the agreement has the authority to perform.
