additional insured. "All Risk" Property Insurance covering all of the Contractor's equipment used to perform the Work. A waiver of subrogation against Amtrak is also to be included. Builder's Risk Insurance providing All Risk coverage on a Completed Value basis, including labor and materials (in place, on site, in storage off-site or in transit). Contractor (and subcontractors) and Amtrak are to be named as Loss Payee, with respect to their interests in the covered property. Railroad Protective Liability Insurance (current ISO Form) with Amtrak as the named insured on the policy. Limits of liability shall be Two Million Dollars ($2,000,000) per occurrence, combined single limit and Six Million Dollars ($6,000,000) annual aggregate. Policy Endorsement CG 28 31 -Pollution Exclusion Amendment is also to be included. A Certificate of Insurance evidencing the above coverages and the original Railroad Protective Policy is required prior to the start of any Work. The City will cause its contractor and any subcontractors to include Amtrak as an additional insured in any insurance policies required by the City in its contracts for the Work. 8. In connection with the renovation of the Station, the City shall obtain local site and building plan approvals and final building inspections. Upon completion of renovation, the City shall obtain a certification from the architect of the renovation project that the Work was constructed inconformity with all the Construction Documents. Upon receipt of such certification, the City warrants that the Station shall be in full compliance with all applicable laws, ordinances and regulations, including without limitation all applicable building codes, zoning, environmental and requirements of the American with Disabilities Act of 1990, as amended (the "ADA"). Notwithstanding the foregoing, the City shall remain liable for the cost or repair or corrections of items of Work to the Station subsequently determined not to have been constructed in accordance with applicable laws, ordinances, regulations zoning or buil cod r ding a equirements in effect at the time of permit issuance. ( ) 9. Amtrak will contnbute to the City up to the full amount of Amtrak's Contribution for the design and renovation of the Station as follows: A) An amount not to exceed Two Hundred Fifty Thousand Dollars ($250,000) towazd the design plans for the renovation of the Station. After Amtrak's receipt, review and approval of the design plans for the Station, the City will submit a detailed invoice for the design costs. Amtrak will pay to the City any undisputed amount up to the maximum $250,000 within thirty (30) days after Amtrak's receipt of the City's invoice. If Amtrak disputes any portion of the invoice, Amtrak will promptly notify the City of the amount in dispute and the reason therefore. Amtrak and the City shall negotiate in good faith to resolve any such dispute. If the parties are unable to resolve the dispute after sixty (60) days, Amtrak shall make the final decision. B) An amount not to exceed the balance remaining of Amtrak's Contribution (after any payment by Amtrak pursuant to Section 9A above) toward the construction,costs for the Work. Upon Substantial Completion, the City will submit an invoice for construction costs of the Work. Amtrak will pay to the City any undisputed amount up to the maximum balance remaining from Amtrak's Contribution within thinly (30) days after receipt of the City's invoice.
