NOTICE OF STREET TREE AGREEMENT <br /> KNOW ALL BY THESE PERSONS: That Judith Y. Wilson, hereinafter referred to as "Developer" and the <br /> City of Eugene, a municipal corporation of the State of Oregon, hereinafter referred to as "City," have entered <br /> into an agreement governing the purchase, installation and establishment of street trees, granted in accordance <br /> with Eugene Code Sections 2.019 and 7.280, adopted Administrative Rule R-7.280, a copy of which is filed <br /> with this agreement in the City Recorder's Office. Eugene Code Section 7.280 and the Rule specify that <br /> approval of a development that involves the creation of a street shall not be granted unless the applicant has <br /> submitted and received approval of a Street Tree Plan or executed an agreement with the City to ensure that <br /> street trees will be lasted and established in accordance with Ci standards, rules, rocedures and olicies. <br /> ~ p . tY p p <br /> The Street Tree Plan is referenced in the agreement as Exhibit "C," and is filed with the agreement in the City <br /> Recorder's Office. This street tree agreement was granted to allow purchase, installation and establishment of <br /> j street trees in Dove Tree Subdivision, a legal description of which is attached as Exhibit "A". <br /> The use and development of the above property is governed by the terms and conditions of that Street Tree <br /> Agreement and the attached plans and specifications made by and between said parties on the above date. <br /> Said Agreement and the approved plans are recorded in the City of Eugene City Recorder's Office, and to <br /> which reference is hereby made for all matters and things therein contained. <br /> IN WITNESS WHEREOF, the parties hereto have set their hand and seal this day of <br /> ~ ,19 <br /> DEVELOPER -Judith Y.
