Contracts & Agreements <br /> No. 17608 <br /> LOCAL AGENCY AGREEMENT <br /> HIGH PRIORITY PROJECT <br /> FERN RIDGE BIKE PATH <br /> <br /> THIS AGREEMENT is made and entered into by and between THE STATE OF OREGON, <br /> acting by and through its Department of Transportation, hereinafter referred to as "State", <br /> and THE CITY OF EUGENE, hereinafter referred to as "Agency". <br /> RECITALS <br /> 1. By the authority granted in ORS 190.110, 366.770, and 366.775, State may enter into <br /> cooperative agreements with the counties, cities, and units of local government for the <br /> performance of work on certain types of improvement projects with the allocation of costs <br /> on terms and conditions mutually agreeable to the contracting parties. <br /> NOW THEREFORE, the premises being in general as stated in the foregoing recitals, it is <br /> agreed by and between the parties hereto as follows: <br /> TERMS OF AGREEMENT <br /> 1. Under said provisions, Agency plans and proposes to extend the Fern Ridge Bike Path <br /> from Terry Street to Greenhill Road, hereinafter referred to as "Project". The location of <br /> the Project is approximately as shown on the sketch map attached hereto, marked Exhibit <br /> A, and by this reference made a part hereof. <br /> 2. The Project shall be conducted as a part of the Transportation Equity Act for the 21St <br /> Century (TEA-21) High Priority Projects (Subtitle F, Section 117) and the Enhancement <br /> Program under Title 23, United States Code, and the Oregon Action Plan. The total <br /> Project cost is estimated at $2,600,000. The High Priority Program Federal Funds are <br /> limited to $1,170,000, subject to annual obligation authority imposed by TEA-21 and the <br /> appropriation bills (see Exhibit B, attached hereto and by this reference made a part <br /> hereof). The Federal pro-rata share funding for the High Priority Program funds is 80 <br /> percent. Eligible costs will be reimbursed at 80 percent until the authorized High Priority <br /> Program Federal Funds limit is reached. The Enhancement Program funds are limited to <br /> $937,000. The maximum allowable Federal fund pro-rata will be used for the <br /> Enhancement Program Federal Funds. <br /> <br />
