NOTICE OF STREET TREE AGREEMENT <br /> i <br /> KNOW ALL BY THESE PERSONS: That Darrell J. Gibson & Lisa M. Gibson., hereinafter referred to as <br /> "Developer" and the City of Eugene, a municipal corporation of the State of Oregon, hereinafter referred to as "City," <br /> -have entered into an agreement governing the purchase, installation and establishment of street trees, granted in <br /> accordance with Eugene Code Sections 2.019 and 7.280, adopted Administrative Rule R-7.280, a copy of which is <br /> filed with this agreement in the City Recorder's Office. Eugene Code Section 7.280 and the Rule specify that <br /> approval of a development that involves the creation of a street shall not be granted unless the applicant has <br /> submitted and received approval of a Street Tree Plan or executed an agreement with the City to ensure that street <br /> trees will be planted and established in accordance with City standards, rules, procedures and polices. The Street <br /> Tree Plan is_referenced in the agreement as Exhibit "C," and is filed with the agreement in the City Recorder's <br /> Office. This .street tree agreement was granted to allow purchase, installation and establishment of street trees in <br /> Gibson Acres Subdivision, a Legal description of which is attached as Exhibit "A". <br /> The use and development of the above property is governed by the .terms and conditions of that Street Tree <br /> Agreement and the attached plans and specifications made by and between said parties on the above date. Said <br /> Agreement and the approved plans are recorded in the City of Eugene City Recorder's Office, and to which reference <br /> is hereby made for alI matters and things therein contained. <br /> IN WITNESS WHEREOF, the parties hereto have set their hand and seal this day of <br /> 19 <br /> DEVELOPER -Darrell J.
