Contracts & Agreements <br /> No. 23,359 <br /> City of Eugene Contract 2007-00202 <br /> LOCAL AGENCY AGREEMENT <br /> TRANSPORTATION ENHANCEMENT PROGRAM PROJECT <br /> i West Bank Trail Extension: River Avenue -Beaver Street <br /> City of Eugene <br /> i <br /> ~ THIS AGREEMENT is made and- entered into by and between the STATE OF OREGON, <br /> acting by and through its Department of Transportation, hereinafter referred to as "State," <br /> ~ and the CITY OF EUGENE, acting by and through its designated officials, hereinafter <br /> referred to as "Agency." <br /> RECITALS <br /> <br /> ~ 1. River Avenue and Division Avenue are part of the city street system and the West <br /> Bank Trail is part of the city trail system, all under the jurisdiction and control of the <br /> Agency. <br /> 2. By the authority granted in ORS 190.110, 366.572 and 366.576, State may enter into <br /> cooperative agreements with counties, cities and units of local governments for the <br /> performance of work on certain types of improvement projects with the allocation of <br /> costs on terms and conditions mutual) a <br /> y greeable to the contractin arties. <br /> gp <br /> 3. Under provisions of the Safe, Accountable, Flexible, Efficient Transportation Equity <br /> Act: A Legacy for Users (SAFETEA-LU), Oregon is required to set aside federal funds <br /> for projects to address transportation enhancement activities, hereafter referred to as <br /> Enhancement Funds. <br /> .NOW THEREFORE, the premises being in general as stated in the foregoing recitals, it is <br /> agreed by and between the parties hereto as follows: <br /> TERMS OF AGREEMENT <br /> 1. Under said provisions, State and Agency agree that Agency shall construct a new <br /> section of the West Bank Trail shared-use path from River Avenue to Beaver Street, <br /> and a connecting path south from the Beltline Road overcrossing, hereinafter referred <br /> to as "Project." The location of the Project is approximately as shown on the sketch <br /> map attached hereto, marked "Exhibit A," and by this reference made a part hereof. <br /> 2. The Project shall be conducted as a part of the Transportation Enhancement Program <br /> under. Title 23, United States Code, which incorporated SAFETEA-LU. The total <br /> Project cost is estimated at $1,181,300, which is subject to change. The <br /> Enhancement Funds are estimated at $1,060,000 with Agency .providing the match <br /> and any non-participating costs, including all costs in excess of the available federaP <br /> funds.
