Master Certification Agreement 24651 <br /> City of Eugene Contract #2007-00202 <br /> Oregon Department of Transportation <br /> LOCAL AGENCY CERTIFICATION PROGRAM <br /> Supplemental Project Agreement No. 24796 <br /> ~ West Bank Trail Extension: River Avenue to Beaver Street <br /> THIS AGREEMENT is made and entered into by and between THE STATE OF <br /> OREGON, acting by and through its Department of Transportation, hereinafter referred to <br /> as "State," and the City of Eugene acting by and through its City Manager, hereinafter <br /> referred to as "Agency," hereinafter collectively referred to as the "Parties." <br /> ~ RECITALS <br /> 1. By the authority granted in Certification Program Agreement No. 24651,, <br /> incorporated herein and by this reference made a part hereof, State may enter into <br /> this Supplemental Project Agreement with Agency for the performance of work on this <br /> <br /> ~ improvement project. <br /> 2. The subject project in this Supplement Project Agreement is one of the required test <br /> projects that constitute conditional certification described in Local Agency <br /> Certification Program (Certification Program) Agreement No. 24651. The <br /> Certification Program allows State to certify a Local Agency's procedures and <br /> delegates authority to the certified Local Agency to administer federal-aid projects <br /> that are not on the National Highway System. <br /> 3. River Avenue and Division Avenue are part of the city street system and West Bank <br /> Trail is part of the city trail system, all under the jurisdiction and control of Agency. <br /> NOW THEREFORE, the premises being in general as stated in the foregoing recitals, it is <br /> agreed by and between the Parties hereto as follows: <br /> TERMS OF AGREEMENT <br /> 1. Under such authority, Agency agrees to construct a new section of the West Bank <br /> Trail shared-use path from River Avenue to Beaver Street, and a connecting path <br /> south from the Beltline Road overcrossing, hereinafter referred to as "Project." The <br /> location of the Project is shown on the sketch map attached hereto, marked "Exhibit <br /> A," and by this reference made a part hereof.u <br /> 2. The Project shall be conducted as a part of the Transportation Enhancement <br /> Program under Title 23, United States Code, which incorporated SAFETEA-LU. The <br /> total Project cost is estimated at $1,181,300, which is subject to change. The <br /> Enhancement Funds for this Project are estimated at $1,060,000 with Agency <br /> providing the match and any non-participating costs, including all costs in excess of <br /> the available federal funds. The funds shall be used for the design and construction <br /> of the Project.. <br /> 1 <br /> <br />
