Contracts & Agreements <br /> No. 23,423 <br /> .LOCAL AGENCY AGREEMENT <br /> HIGH PRIORITY PROJECT <br /> ~ Delta Ponds Path: Goodpasture Island Road -Robin Hood Avenue <br /> Amendment No. 1 <br /> i <br /> The State of Oregon, acting by and through its Department of Transportation, <br /> hereinafter referred ~to as "State", and the CITY OF EUGENE, acting by and through its <br /> j elected ofiacials hereinafter referred to as "Agency", entered into an Agreement on <br /> December 22, 2006. Said Agreement covers the construction of agrade-separated <br /> bicycle/pedestrian facility crossing over Delta Highway connecting Goodpasture Island <br /> Road on the west and Robin Hood Avenue on the east. <br /> i <br /> <br /> i <br /> It has now been determined by State and Agency that the Agreement referenced above, <br /> although remaining in full force and effect, shall be amended to increase costs by adding <br /> Transportation Enhancement funding to the Project. <br /> Paragraph 2 of Terms of Agreement, Page 1, which reads: <br /> 2. The Project shall be conducted as a part of the High Priority Projects Program <br /> authorized under SAFETEA-LU. The total Project cost is estimated at $.4,796,000, <br /> which is subject to change. The High Priority Projects Program Funds available for <br /> the Project are estimated at $2,880,000 with Agency providing the match for the <br /> federal funds and any non-participating costs, including all costs in excess of the <br /> available federal funds. The federal pro-rate funding for the project is 89.73 percent <br /> and provided federal funds will be subject to annual obligation limitations and <br /> possible rescissions. The funds shall be used for all phases of work. <br /> Shall be deleted in its entirety and amended to read: <br /> 2. The Project shall be conducted as a part of the High Priority Projects Program <br /> authorized under SAFETEA-LU and the Transportation Enhancement Program, <br /> . Under Title 23,.
