<br />40. Covenants, Conditions and Restrictions, but omitting Restrictions, if

<br />Instrument, including the terms and provisions thereof, being a right of
<br />reverter to the State of Oregon, State Land Board, dated March 17, 1960,
<br />recorded, March 21, 1960, Reception No. 94094, Official Records Lane County,
<br />as follows:
<br />"said premises described herein shall at all times be used for public
<br />purposes and benefit only."

<br />43. An easement, created by Instrument, including the terms and provisions
<br />thereof, recorded October 6, 1960, Reception No. 12106, Official Records
<br />Lane County, in favor of the City of Eugene, for a power line easement.
<br />44. Covenants, Conditions and Restrictions, but omitting Restrictions, if
<br />any, based on race, color, religion or national origin, imposed by
<br />Instrument, including the terms and provisions thereof, dated February 21,
<br />1961, recorded February 27, 1961, Reception No. 24438, Official Records Lane
<br />County, as follows:
<br />"The above property is to be used for public purposes."
