Obligations <br />incurred under the authority of this section need not be payable in the same biennial period during which <br />the obligation is incurred. [1953 c.125 §2] <br /> 366.517 Department may determine certain accounting procedures. <br /> The Department of <br />Transportation shall determine the accounting period for which any expenditures shall be charged against <br />the State Highway Fund. The department may charge such expenditures against the State Highway Fund at <br />the time the expenditures are actually paid even though the expenditures were obligated during a prior <br />accounting period. The department may keep its accounts on a calendar year basis. [1953 c.125 §3; 1967 <br />c.454 §40] <br /> 366.518 Expenditures from highway fund to be reported, budgeted and limited to amounts <br />budgeted. <br /> The Department of Transportation shall submit a biennial statement and budget estimate as <br />required by law, and shall limit its expenditures from the State Highway Fund during each biennial period <br />to the total amount of the budget approved according to law; provided, that the word expenditures shall <br />mean all money actually paid out or due and payable, but shall not mean liabilities or obligations incurred <br />but not due and payable until a subsequent biennial period. The provisions of any law establishing a <br />Legislative Assembly emergency committee shall apply to expenditures from the State Highway Fund. <br />[1953 c.125 §4] <br /> 366.520 Expenses in legalizing state highways. <br /> The expenses incurred in any proceeding by the <br />Department of Transportation under ORS 368.201 to 368.221, when applied to state highways, shall be <br />paid out of the highway fund. [Amended by 1981 c.153 §62] <br /> 366.522 Appropriations from highway fund for legislative interim committees. <br /> It hereby is <br />declared to be the policy and intent of the Legislative Assembly that the total appropriations out of the State <br />Highway Fund made by it for the payment of expenses incurred by the Legislative Assembly by and <br />through its interim committee during any biennium shall be deemed to be the maximum amount necessary <br />for such purpose. Any unexpended and unobligated balance remaining in any such appropriation heretofore <br />or hereafter made shall, after the expiration of the biennium for which the appropriation was made, be <br />returned to the State Highway Fund and may thereafter be used for any purpose authorized by law.
