title=31 page=1 <br />may deem for the best interests of the general public. <br /> 366.470 Agreements with railroad companies for snow removal. <br /> (1) The Department of <br />Transportation may enter into agreements with a railroad company for the removal of snow from highway <br />and railroad whenever a state highway is in close proximity to a railroad track and by reason thereof and in <br />order to remove from the highway snow and ice which has blocked or threatens to block the highway to <br />traffic it becomes necessary to cast such snow and ice upon the railroad tracks, thereby impairing or <br />interfering with train movement and tending to block train operations. The agreement may be made during <br />or in anticipation of any such contingency, shall be in writing and shall fix the terms and conditions under <br />which and the extent to and manner in which the state may, in removing the snow and ice from the <br />highway, cast it upon the railroad tracks. <br /> (2) The department may procure or cause to be executed by a corporation authorized to do such <br />business in the state, a liability policy of insurance, an irrevocable letter of credit issued by an insured <br />institution, as defined in ORS 706.008, or an undertaking running in favor of the state, the department, the <br />railroad company and their officers and such employees of such parties as the contracting parties may <br />designate. <br /> (3) The insurance, letter of credit or undertaking: <br /> (a) Shall be acceptable to the contracting parties. <br /> (b) Shall in any event indemnify, protect and hold harmless the railroad company, its officers and <br />employees designated, the state, the department, its officers and employees designated, from all claims for <br />damage occasioned by or in connection with the removal of snow from the highway and the casting of the <br />snow upon the railroad tracks. <br /> (c) May, if so provided, reimburse either or both of the contracting parties for loss, cost and expense <br />incurred in connection with or resulting from such work. <br /> (4) The department may pay out of the highway fund the premium for the insurance or for the fee for <br />the letter of credit and the cost and expense incurred or sustained by the railroad company and the state <br />incident to the snow removal.
