~ity~'~~~T <br />Agreement No. ~4~5~ <br />Guide, City of Eugene Public Contracting Rules adapted pursuant to ORS <br />279A.065(5). <br />3. pity acknoledges and agrees that State, the Oregon Secretary of State's office, <br />~J~T office of Inspector general, l=l~v~A, any ether federal government agency} <br />and their duly authorised representatives h~~ have access to such fiscal records and <br />ether books, project dacurr~ents, papers, plans and Writings of pity pertaining to work <br />covered by the Suppler~ental Project Agreements to perform examinations and audits <br />and nuke excerpts and transcripts. pity is responsible for using its procedures} a <br />approved by ~~~T, for project documentation and long term retention of project <br />documentation. pity shall ensure that the contractor and subcontractors} rr~ainta~n the <br />records and keep the records accessible and available at reasonable times and <br />places for a minimum period of six years from the date of final payment under the <br />contract or subcontract or until the conclusion of any audit, controversy or litigation <br />arising out of or related to the contract, ~vhichever date is later, unless a different <br />period is required by lauv. See the Secretary of State's Retention Schedule; e.g. ~A~ <br />chapter ~ ~, division ~ ~~ for counties, boo for cities and ~~ for state agencies, ~rhi <br />shall include, but is not limited to: <br />a. dailyork records; <br />b. quantity documentation; <br />c. material invoices and quality documentation; <br />d. certificate of materials origin; <br />e. process control records; <br />f, project diary} <br />g, erosion control reports; <br />h. temporary protection and direction of traffic reports; <br />i. foreign steel summary; <br />j. fast results; and <br />k, inspection records to ensure that projects arc completed in conformance uvith <br />approved plans and specifications. <br />4. pity shad retain and peep all files and records for a minimum of three ~} gears <br />following the date of final voucher to ~1~~I11A. copies of such records and accounts <br />shall be made available upon request. for real property and equiprnent, the retention <br />period Starks ~ron~ the date of disposition {~ritle ~9 l'~ Part ~ ~ Subpart 4}, <br />pity ~nd~n~n~~icatlon <br />~ . pity shall, to the extent permitted by State lair, indemnify, hold harmless and provide <br />legal defense for State against all claims brought bythe contractor, or others resulting <br />from pity's failure to con~plith the terms of this Agreement <br />~. n all construction projects where pity is doing the construction engineering and <br />project management, pity, subject to any limitations imposed by State iav~r and the <br />Oregon constitution, agrees to accept a~~ responsibility, defend lawsuits, inden~n~fy <br />~7 <br />
