~~ ~ <br />~~ <br />~ <br />AMENDED AND RESTATED INTERGOVERNMENTAL AGREEMENT <br />forthe <br />JOINT USE AND DEVELOPMENT OF <br />YOUTH SPORTS PARKS AND ATHLETIC FIELDS <br />BETINEEN: School District 4J, a unit of local ("District") <br />government of the State of Oregon <br />AND: 'fhe City of Eugene, a unit of local ("City") <br />government of the State of Oregon <br />RECITALS <br />A. ORS 190.010 provides that units of local government may enter into agreements for the <br />performance of any and all functions and activities that any party to the agreement, its assigned <br />personnel or agents have authority to perform. <br />B. City and District have successfully shared the use, operation and maintenance of facilities for <br />many years and desire to continue to share resources and work collaboratively to jointly develop and <br />manage the youth sports parks and athletic fields described in this agreement. <br />C. On March 28, 2000, City and District entered into an Intergovernmental Agreement in the spirit <br />of cooperation and with the commitment that the shared facilities will be used extensively by the <br />community, especially by its children and youth, and that they will be maintained in good repair for <br />many decades to come. Pursuant to Section 2.2 of that Agreement, City and District recently reviewed <br />the Agreement and determined, with the same spirit of cooperation, they wished to further provide for <br />such use and maintenance for new fields developed by the Parties as well as for fields they hope to <br />develop in the future. <br />D. City and District further agree their respective responsibilities relating to the shared use, <br />operation, and maintenance of the Parks Premises of the Youth Sports Parks, as defined in Appendix B; <br />can and should be further described. The Parties wish to define their respective responsibilities relating <br />to the Parks Premises in order to identify the responsibilities for the operation and maintenance of <br />those facilities as the City's, pursuant to the terms of this Agreement. <br />E.
