Notes: Assistance in the Interpretation of Eugene Code for the Amazon Alignment for the West <br />Eugene EmX Extension (WEEE) <br />Meeting Date: July 17, 2008 <br />Attendees: Gabe Flock, Jason Dedrick, Planning and Development; Tom Schwetz, Mary Archer, Lane <br />Transit District <br />Amazon Ali~nment Uses <br />Development established before May 24, 1995 is considered "prior development" and is <br />considered exempt (excluded) from the WP Overlay Zone. Exemption status of current exempt <br />property would carry over if acquired for by LTD or the City for project purposes. For example, <br />24' (width of two lanes) could be allowable in an area that has existing "prior development" (see <br />code language at EC 9.4720). <br />• The use within the buffer area must meet code requirements (see EC 9.4700-9.4760 and related <br />standards of the NR zone beginning at EC 9.2500). <br />• Use appears to be allowed subject to site review approval within the setback/buffer areas <br />established by the WP Overlay Zone, as provided by the following code excerpt and subject to <br />process and standard requirements: <br />9.4730 (3) (c) <br />Construction of public improvements (including but not limited to streets, sanitary <br />and storm sewers, bridges, bikeways, pedestrian paths, maintenance access roads and <br />public utilities) required by this land use code or speci~ed in adopted plans. Subject to <br />EC 9.2530 Natural Resource Zone Development Standards (2) through (10), and (13) <br />through (19). <br />• Need to verify that the RTP (or other adopted plans) contains required specification that allows <br />for consideration of Bus Rapid Transit along the alignment of the Amazon Channel. <br />• Additional components of project, if included (such as possible realignment or reconfiguration of <br />channel, or enhancement/restoration within buffer areas) may trigger additional standards as <br />part of the site review land;use application process. <br />Park and Ride Uses <br />• Look at base zoning. <br />• Look at allowable uses for Park and Rides in Eugene Code <br />• Park and Ride uses are permitted in industrial zone areas <br />• Park and Ride uses 100+ spaces in commercial zone areas require site review <br />• Park and Ride uses under 99 spaces in commercial zone areas may not require site review <br />Next Steps• <br />1.
