COREY Kurt A <br />From: MEDLIN Johnny R <br />Sent: Monday, November 05, 2007 10:06 AM <br />To: JONES Angel L; COREY Kurt A <br />Cc: LIDZ Jerome (Harrang) <br />Subject: Alton Baker Park - U of O use of Lots 8 and 9 <br />Continuing the research I've been passing along to you on this subject: <br />Last month in a meeting, the leadership of the Whilamut Citizen Planning Committee of East Alton Baker Park stated that <br />the City Council had already decided back in 2001 that lots 8 and 9 would be returned to parkland at the end of 2007. <br />Their view was that because of that Council action, city staff did not have the authority to execute a new IGA with the <br />University of Oregon allowing their use lots 8 and 9 after the end of this year. That hadn't been my understanding, so I told <br />them I would need to research the issue. I read the minutes of the January 22, 2001 Council meeting and was frankly <br />confused at what the end result was of the main motion and 2 of Councilor Bettman's 4 amendments being approved. <br />I asked the City Attorneys Office to review these Council minutes in which the Council approved the plan for dealing with <br />the Autzen Transportation Demand Management (TDM) plan, the University's payment to the Science Factory for moving <br />them out of the city owned paved parking lot near the SF facility, and the University's continuation of use of the city owned <br />lots 8 and 9. <br />The resulting attorney opinion (copy available if you wish) is that the leadership of the CPC was likely correct. Due to the <br />Council passing Councilor Bettman's #4 amendment to the main motion, any modification or extension to allow UofO use <br />of lots 8 or 9 after the end of this year will require the approval of the City Council. <br />Thanks <br />Johnny <br />
