In the event of breach of any of the above non-discrimination covenants, <br />State shall have t.he right to terminate this leass, to re-enter and repossess <br />the premises, incl~iding the facilities thereon, and to hold the same as though <br />this lease had never been made or issued. <br />28, There is an agreement,dated March 22, 1971, now in full force and effect, <br />whereby the City has agreed to prepare the designs for grading, walkways, land- <br />scaping, recreational facilities, and other features related to the multiple-use <br />concept of the project. Upon City's completion of said design work and State's <br />approval thereof., State shall perfoYm the grading and construct the walkway <br />system as a part of the project. <br />2'9. Upon completion of the project State shall let an additional contract, <br />incorporating City's design, for the installatibn of an irrigation system, turf, <br />landscaping, and all other facilities that are approved by the Federal Highway <br />Administration as items eligi.ble for participation with Federal funds. This will <br />require a separate agreement to clearly define State and City responsibiliti~es <br />related to the furnishing of water arid maintenance of the facilities. <br />IN WITNESS WHEREOF, the parties hereto have set their hands anti affixed <br />their seals as of the day and year hereinafter written.
