z . . <br />~.. . , _ .. <br />' ~ ,. <br />All the land within the right-of-way of the Euyene-Springfield <br />Highway (I-105), includinq the air-space ueneath the structure <br />having a minimum vertical clearance of eight (8) feet, and <br />bounded on the north by First Avenue, on _.ie south by Seventh <br />Avenue, on the east by Washington Street, and on the west by <br />Jefferson Street. <br />2. The period of this lease shall be for twenty-five (25) years and may <br />be renewed for an additional period of twenty-five (25) years by mutual agreement <br />of the parties. <br />3. This agreement shall comply with the Federal Highway Administration's <br />POlicy and Procedure Memoranda 80-10.1 and 80-10.2 dated August 7, 1970. In the <br />event of any conflict.between said memoranda and the provisions of this agree- <br />ment, the more restrictive requirements shall prevail. <br />4. City shall keep in force liability insurance with a company or companies <br />approved by State and in a form satisfactory to State, to protect against any <br />liability incident to use or occupation of the premises by City, for injury to or <br />death of any person in the amount of not less than $500,000.00 for the claim of <br />one person and $1,000,000.00 for the claims of all persons, resulting from each <br />occurrence, and for damage to property in the amount of not less than $300,000.00 <br />Said policies shall name as additional insureds "the State of Oregon, the State <br />Highway Commission, its members, officers, agents and employees," except as to <br />claims against the primary named insured for injury or death to the persons of or <br />damage to the property of the State of Oregon, the State Highway Commission, its <br />members, officers, agents or employees. A certificate of insurance or copy of each <br />policy shall be furnished by City to State upon the execution of this agreement. <br />5. No advertising signs may be erected or placed on the premises, but City <br />may erect and place at its own expense, such directional and informational signs <br />and notices as are approved by State. <br />6. City shall maintain the premises, and facilities placed thereupon, at <br />its own expense, and shall be responsible for the use of the premises by the public <br />and shall take all reasonable precaution to ,prevent rowdiness or other objection- <br />able conduct on the premises. <br />7. City shall, at its own expense, keep the premises at all times clean, <br />safe, sanitary, and free of any debris, and shall pay for any utility services <br />furnished to the premises, including installation of ineters. <br />8. No gasoline supply station or gasoline pumps shall be installed,,placed, <br />or operated on the prenises; nor shall vehicles used or designed for the trans- <br />portation of gasoline, petroleum products, chemicals, or explosives be permitted <br />to park on the premises; nor shall bulk storage of gasoline, petroleum products, <br />chemicals, or explosives be permitted on the premises. <br />- 5- <br />
