After State has requested City to move ANY OF THE ABOVE-MENTIONED <br />CITY-OWNED UTILITIES OR FACILITIES, City shall notify the engineer prior to <br />commencing the relocation work on such utilities or facilities so that the <br />relocation work can be properly coordinated with the other work of the project. <br />7. City shall allow state engineers and/or inspectors to inspect ANY <br />RELOCATION OF UTILITY conduits, lines, poles, mains, pipes, and other such <br />FACILITIES, AS DESCRIBED IN PARAGRAPHS 3 AND 4 in order to dete naine whether <br />said utilities or facilities have been relocated in accordance with the plans <br />for the project. <br />8. City shall obtain State's concurrence and/or approval of any NEW <br />UTILITY INSTALIATIONS within the right of way of the project, or EXISTING UTILITIES <br />RETAIN~,D within the right of way. <br />9. City agrees that no city street shall be constructed turning into <br />or intersecting the throughway unless the plans and specifications therefore have <br />first been submitted to and approved in writinq by State and made a matter of <br />official record. <br />10. City consents to the closure of those streets described in paragraphs <br />3 and 4 under THINGS TO BE DONE BY STATE. <br />11. City shall not permit any encroachments upon the project right-of-way <br />which will cause more than a temporary obstruction to the free and convenient flow <br />of traffic over said highway. <br />12. City, by execution of this agreement, does hereby qive its consent <br />as required by ORS 3,73..030(2), to any and all changes of grade, if any there be <br />in connection with or arising out of the construction of the project with the <br />city limits. <br />13. City shall enact and enforce, or keep in eff~ct and enforce, an <br />ordinance or resolution prohibiting parking, except for emerqencies, on both <br />sides of that portion of the throughway that is located within the city limits. <br />14. In compliance with various rules, regulations, and policies, the <br />City shall obtain from State prior approval of any future changes, including <br />traffic-control measures, that may affect this agreement. <br />15. City shall pass an ordinance or resolution, as the case may be, <br />authorizing the Mayor and Recorder to enter into this agreement, and the same <br />shall be made a part hereof and attached hereto. <br />LEASE PROVISIONS: <br />1. State, for and in consideration of the covenants, conditions, agreements <br />and stipulations of City herein, does hereby lease unto City for park purposes, <br />the following described real property: <br />-4- <br />
