This agreement supersedes that portion of a previous agreement, <br />dated January 31, 1967, covering the 7th Avenue-Willamette Ftiver Section as it <br />relatES to the City of Eugene. This agreement is necessary due to implementation <br />of the multiple-use concept and proposed use of air-space by City. <br />9. Attached hereto, marked Exhibit A, and by this reference made a part <br />hereof, is a sketch map setting forth the general location, for the <br />project, to show the general route of the project, its connections, and other <br />features of a general nature. <br />NOW, THEREFORE, the premises being in general as stated in the foregoing <br />RECITALS, it is agreed by and between the parties hereto as follows: <br />THINGS TO BE DONE BY STATE: <br />1. State, by execution of this agreement, approves the RECZTALS herein, <br />Exhibit A, the provisions of THINGS TO BE DONE BY CITY, and all other provisions <br />set forth in this agreement. <br />2. State shall prepare all plans, obtain the neces~ary right-of-way, by <br />purchase or othezwise, let and award all contracts, supervise construction and, <br />following completicn, thereafter maintain the throughway, separation structures, <br />and connections on the project within the access control area of the throughway <br />approximately as shown colored in green on the attached Exhibit A. <br />3. State shall close the following roads, streets, or ways along the through- <br />way that are not connected thereto and same shall be accomplished by means of a <br />barrier at the right-of-way or access control line of the throughway and include <br />warning signs, where applicable. Said closures are approximately as shown by means <br />of a red line on t~e attached Exhibit A. <br />3. Cheshire Avenue at the easterly boundary of Jefferson Street <br />and the westerly boundary of Washington Street. <br />b. Clark Avenue at the easterly boundary of Jefferson Street <br />and the westerly boundary of Washington Street. , <br />c. Fourth Avenue at the easterly boundary of Jefferson Street <br />and the westerly boundary of Washington Street. <br />4. State, after obtaining concurrence of City, may close any other roads, <br />streets, or ways within the right-of-way boundaries of the throughway that may <br />interfere with the free and convenient flow of traffic on the new facility, which <br />are not presently determined and, therefore, not shawn on the attached Exhibit A. <br />5. State shall, without cost to City, relocate or cause to be relocated <br />all existing privately-owned utility conduits, lines, poles, mains, pipes, and <br />other such facilities that are located on_private property where such relocation <br />is necessary to conform said utilities or facilities to the plans for the project. <br />-2- <br />
