,. . - ~ <br />_~ <br />~:.... ,;.-. <br />, AMENDMENT TO INTERGOVERNMENTAL AGREEMENT <br />BETWEEN <br />EWEB, LANE COUNTY AND THE UNIVERSITY OF OREGON <br />CONCERNING THE AUTZEN FOOTBRIDGE <br />Thi,s is an amendment to the Intergovernmental Agreement entered <br />into between the City of Eugene, Oregon, a municipal corporation of the <br />State of Oregon acting by and through the Eugene Water and Electric <br />Board, hereinafter referred to as EWEB; and Lane County, a political <br />subdivision of the State:of Oregon, hereinafter referred to as COUNTY; <br />and the State of Oregon, acting by and through the State Board of <br />Hiqher Education, on.behalf of the University of Oregon, hereinafter <br />referred to as STATE. <br />~ WHEREAS, STATE, COUNTY and EWEB entered into an agreement in 1982 <br />regarding the management and maintenance of the Autzen Footbridge <br />("Agreement"); <br />WHEREAS, the City of Eugene, hereinafter referred to as CITY, and <br />COUNTY entered into an Intergovernmental Agreement on October 27, 1987 <br />providing for the conveyance of Alton Baker Park from COUNTY to CITY <br />ownership; <br />WHEREAS, said Alton`~Baker Park agreement was amended on September <br />9, 1990 to include conveyance of ownership of the Autzen Footbridge <br />from COUNTY to CITY. <br />Pursuant to Paragraph 14 of the Agreement, the Agreement is amended <br />to provide as follows: <br />CITY:assumes the.rights and responsibilities assumed in the <br />Agreement by COUNTY,~except as noted below, effective November 19, <br />1990, the..date ownership was conveyed from COUNTY to CITY, as evidenced <br />by the transfer, documents lieing filed with Lane County Records. <br />Paragraph 4 of the Agreement is.amended to add CITY and to require <br />approval of all four agencies. <br />COUNTY hereby grants~CITY permission to place the north end of the <br />Autzen Footbridge on adjoining.County-owned property and further grants <br />CITY permission to enter.on County-owned land adjacent to said end of <br />the bridqe as.necessary for maintenance and repair of the bridge. <br />COUNTY shall not unreasonably revoke this permission, and shall give <br />CITY at Teast three months notice.of revocati'on. <br />Paragraph ll of the Agreement is amended to add the following <br />contact.person: . <br />CITY~- Director, Department of Public Works <br />Contract,,_ ~~ 87-00729 <br />
