INTERGOVERNMENTAL CONTRACT <br />BETWEEN: City of Eugene, an Oregon municipal corporation (City) <br />AND: Metropolitan Wastewater Management Commission, a unit <br />of loc l government of the State of Oregon (MWMC)' <br />~ ~. EFFECTIVE ~ ~ <br />DATE: <br />RECITALS <br />A. ORS 190.010 provides that units of local government may <br />enter into agreements for the performance of any and all <br />functions and acti~ities that any party to the agreement; its <br />officers or agents have authority to perform. <br />B. MWMC desires to enter into a contract with City to have the <br />City acquire 'and install a computer control system at the <br />Regional Sewerage Treatment Plant at 410 River Avenue, Eugene, <br />Oregon (Plant). <br />C. Because of City's ongoing obligation to maintain and operate <br />the Plant and because of City's experience and knowledge in <br />operation of the Plant, MWMC, upon the conditions herein <br />provided, desires to retain the services of City to oversee the <br />acquisition and installation of a new computerized control system <br />for the Plant. <br />AGREEMENT <br />1. Work to be Provided. City agrees to provide to MWMC the <br />services described in Exhibit A attached hereto and by -this <br />Intergovernmental Contract - 1 <br />
