~ w'~ >`- <br />Contract "9 - vC~3G~~ <br />INTERGOVERNMENTAL AGREEMENT <br />THIS AGREEMENT, entered,into by and between Lane Council of Governments, <br />an organization of~governments within Lane County, Oregon, hereinafter <br />referred to as L-COG, and the City of Eugene, a local municipality of <br />the State of Oregon, hereinafter referred to as CITY. <br />WHEREAS, ORS 190.010 provides"that units of local.government may enter <br />into agreements for the performance of any or, all functions and <br />activities that a party to the agreement, its officers or agents, have <br />authority to perform; and <br />WHEREAS, the City of Eugene Public Works Department-Transportation <br />Division needs assistance with transportation modeling, traffic <br />forecasting and analysis for the preparation of~an Environmental Impact <br />Statement for the Ferry Street Bridge; and <br />~ <br />WHEREAS, L-COG and the CITY have agreed that services needed by the CITY <br />exceed the,tasks which can be accomplished through tfie transportation <br />planning tasks included in L-COG's Unified Planning Work Program for <br />transportation planning;,and <br />WHEREAS, L-COG has special expertise in transportation modeling and <br />traffic forecasting; has ready access to data sources, methods and <br />programs for the analysis; and generally has the capability to conduct <br />such work activities with management, planning, and research staff for <br />the CITY; and` <br />WHEREAS, the scope of work is as generally described i.n Attachment A and <br />the costs of these services for the CITY will be $43,500.. <br />NOW, 7HEREFORE, it .is .agreed that L-COG will perform the work tasks <br />described in Attachment`A resulting in traffic forecasts and maps for <br />use in the Environmental'Impact Statement for Fe'rry Street Bridge. This <br />contract will cover the~time period from March 1, 1989 through December <br />31, 1989. The CIT1' will reimburse L-COG for-actual costs including <br />salary, fringe benefits, and directly attributable,costs on a quarterly <br />basis with a final payment at the conclusion of the project. The total <br />payments under this contract shall not exceed,$43,500. <br />L-COG and the CITY further agree that this agreement may be modified or <br />extended by addenda signed by both parties in the event that the parties <br />jointly determine that there are substantial changes to the work tasks <br />identified in Attachment A.
