PERSONAL SERVICES CONTRACT <br />BETWEEN: The City of Eugene, an Oregon municipal <br />corporation (City) <br />AND: Peter Hel.zer (Artist) <br />RECITALS <br />A. Artist is engaged in the business of.providing bronze scupltures for the <br />five pedestals in the down town mall play area. ` <br />B. City desires to engage Artist to provide the services described in this <br />agreement and Artist is willing to provide such services on the terms and <br />conditions set forth herein. <br />C. The following are attached and incorporated as a part of this contract: <br />Exhibit A- City of Eugene Standard Contract Prov_isions <br />Exhibit B - Payment Schedule <br />AGREEMENT <br />SERVICES TO BE PROVIDED.: Artist agrees to provide to City the following <br />services (the °work"): <br />A. Furnish.and install on the five pedestals in the down town play area <br />bronze sculptur.es of a bear,.three skunks, a porcupine, a raccoon with <br />three babies, and two otters. The sculptures are to be completed and <br />installed by September 30, 1989, in accordance with directions from the . <br />visual arts coordinator to ensure the scupltures are securely anchored <br />to each pedestal and will withstand hor.izontal pressure. <br />TIME FOR COMPLETION. Artist shall commence the work on June 30, 1989, <br />and shall complete the work prior to September 30, 1989. - <br />CONSIDERATION. The consideration which City shall pay to Artist, for <br />both the work performed by Artist and the-expenses incurred by Artist in <br />performing the work, shall not exceed $13,000, based on the schedule of rates <br />described on the attached Exhibit:6. City shall make payments, based on <br />invoices from Artist, together with a progress report containing a summary of <br />the work completed for which payment is requested. City's payment shall be <br />made within 30 days after Artist's statement. Artist shall not be entitled <br />to reimbursement for travel or other expenses unless.specified on the at- <br />tached schedule of rates. If Artist is entitled to reimbursement for any <br />such expenses, they shall be properly documented and submitted in accordance <br />with City requirements. <br />TERMINATION. Notwithstanding any other provision hereof to the con- <br />trary, this contract may be terminated as follows: <br />Personal Services~Contract - 1 ~ <br />
