`' , ~ <br />INTERGOVERNMENTAL AGREEMENT <br />THIS AGREEMENT entered into by and between Lane County, a <br />political subdivision of the State of Oregon, hereinafter referred <br />to as COUNTY, and the CITY OF EUGENE, a municipal corporation of <br />the State of Oregon, hereinafter referred to as EUGENE. <br />RECITALS <br />1. ORS 190.010 and the Lane County Home Rule Charter provide <br />that units of local government may enter into agreements for the <br />performance of any and all functions and activities that are party <br />to the agreements, its officers or agents, have authority to <br />perform. <br />2. Lane County Home Charter, ORS Chapter 373, ORS Chapter <br />368 and ORS 294.950 authorize COUNTY to transfer funds to cities <br />for improvements, construction or repair of streets within the <br />corporate limits of EUGENE. <br />3. EIIGENE has requested road funds from COUNTY to supplement <br />federal Community Development Block Grant funding for neighborhood <br />street improvements adjacent to low and moderate income residences. <br />4. The Board of Commissioners of Lane County, oregon <br />approved an order, #91-2-26-1, on February 27, 1991 authorizing the <br />County Administrator to execute an Intergoyernmental Agreement with <br />the City of Eugene which grants $50,000 of road funds to construct <br />specific road fund projects. <br />5. The City of Eugene is contemplating expending the $50,000 <br />on the specific improvements identified as Whiteaker Traffic <br />Control (4th Avenue/Monroe to Blair); Whiteaker Traffic Control <br />(Blair and Van Buren); Whiteaker Traffic Control (5th Avenue/Polk <br />to Blair); and Sidewalk improvements near Whiteaker School. <br />AGREEMENTS <br />COUNTY AGREES: <br />Upon request of EUGENE to transfer funds in the amount of <br />$50,000 to EUGENE to assist in funding street improvement projects <br />that are adjacent to low and moderate income residences. <br />EUGENE AGREES: <br />1. That project funds transferred to EUGENE from COUNTY road <br />fund will only be used to pay for those eligible activities that <br />are allowed under Article IX, section 3(a) of the Oregon <br />Constitution. EUGENE expressly agrees to defend, indemnify and <br />hold COUNTY harmless for any misexpenditure of these funds. <br />
