3. DURATION: This Agreement between participating parties shall expire <br />October 31, 1991. <br />~ 4. TERMINATION: Either party shall have the right to terminate their <br />participation in this Agreement, without cause, giving ten (10) days prior <br />written notice to the other party. <br />5. NON-APPROPRIATION OF FUNDS: Either party to this agreement may <br />terminate their participation in this Agreement upon conditions of non- <br />appropriation of budget funds, giving ten (10) days prior written notice to the <br />other party. <br />6. Pursuant to 1989 OR Laws Ch. 684, all employers working under this <br />agreement are subject employers that will comply with ORS 656.017, in regard to <br />Workers' Compensation coverage. <br />7. ATTORNEY FEES: If an action is brought to enforce, rescind or <br />otherwise, concerning this Agreement, the prevailing party shall be entitled to <br />recover from the other party, in addition to costs and disbursements allowed by <br />law, its reasonable attorney fees incurred therein, and in any appeal therefrom, <br />in an amount to be determined by the Court. <br />8. AMENDMENTS: Any amendments to this Agreement shall not be effective <br />unless made in writing and signed by all parties. <br />9. RECITALS INCORPORATED: The above recitals are incorporated herein by <br />the reference as though fully set forth. <br />10.
