.r- // - vc~ ~ri ~ <br />- ,,~-- •.^~. ` <br />_ - ~ 91 _ po ~i~ <br />INTERGOVERNMENTAL AGREEMENT <br />THIS AGREEMENT entered into by and between LANE COUNTY, a political <br />subdivision of the State of Oregon,~hereinafter re.ferred to as COUNTY, and the <br />CITY OF EUGENE, a municipal corporation, hereinafter referred to as CITY. <br />RECITALS <br />1. ORS 190.O10 and the L:ane County Home Rule Charter provide that units <br />of local government may enter into agreements for the performance of any and all <br />functions and activities that a party to the agreements, its officers or agents, <br />have authority to perform. <br />2. COUNTY and CITY have established a policy of mutual cooperation on <br />projects of mutual benefit and of benefit to the public at large. <br />3. Both entities are vntended to and shall be deemed an independent <br />contractor in performing its obligations assumed hereunder. Both agencies shall <br />supervise and direct the performance of its obligations and shall determine the <br />means, methods, techniques, sequences and procedures of performing its <br />obligations pertaining.to facilities owned and operated by that agency. <br />4. The parties to this'agreement have determined that a combined auction <br />for the purpose of selling surplus vehicles-:.and equipment would reduce <br />duplication of effort and reduce disposal costs for both parties. <br />NOW, THEREFORE,~in consideration of the mutual covenants and conditions <br />set fortfi herein, the,parties agree as follows: <br />.1. SERVICES AND MATERIALS:. <br />~ a. COUNTY agrees.to pr.ovide the fol.lowing services and materials to <br />CITY as requested at specified prices; <br />1. Sel l sur.pl us CITY owned vehi cl es, and equi pment at COUNTY' S out- <br />of-pocket_cost or 6% of gross sale amount, whichever is less. <br />2. COUNTY shall provide all auction preparation, including, but <br />not limited to: auctioneer, advertising, title and receipt <br />distribution, mileage certification, and accounting for funds <br />received. ~ <br />b. CITY agrees to:deliver.items to be so1d, Federal mileage statements <br />and negoti abl e certi f i cates of owne`rsh i p to COUNTY at 3040 N. Del ta <br />Highway, Eugene, Oregon, not before September 30, 1991, nor later <br />than October 2, 1991. . <br />2. TIME AND MANNER OF PAYMENT:.
