Exhibit B <br />Broadway & Pearl Associates <br />Real Property Lease <br />Option to Renew <br />If Tenant is not then in default, Tenant shall have the right and option to renew this <br />lease for an additional five-year term commencing July 1, 2001 and terminating June <br />30, 2006, In the Event Tenant exercises the option to renew, Tenant shall give <br />Landlord written notice of intent to renew not less than ninety (90) days and not more <br />than one-hundred eighty (180) days prior to the end of the original term. In the event <br />Tenant is not in default and gives the notice to Landlord within the time set forth above, <br />this lease shall be renewed for a period of five (5) years upon the same terms and <br />conditions as set forth herein except for rent. The parties shall meet within thirty (30) <br />days of the date Tenant gives Landlord notice of intent to renew the lease and agree <br />upon the rent which will be determined by market rates then in effect. <br />Arbitration <br />If a dispute arises between the parties concerning the rental rates for the option <br />periods, either party may request arbitration and appoint as an arbitrator an <br />independent real estate professional having knowledge of valuation of rental properties <br />comparable to the Leased Premises. The other party shall also choose an arbitrator <br />with such qualifications, and the two arbitrators shall choose a third. If the choice of the <br />second or third arbitrator is not made within ten (10) days of the choosing of the prior <br />arbitrator, then either party may apply to the presiding judge of the judicial district <br />where the Leased Premises are located for appointment of the required arbitrator. <br />The arbitration shall proceed according to the Oregon statutes governing arbitration, <br />and the award of arbitrators shall have the effect therein proyided. The arbitration shall <br />take place in the county where the Leased Premises are located. Costs of the <br />arbitration shall be shared equally by_ the parties, but each party shall pay its own <br />attorney fees incurred in connection with the arbitration <br />lease Initial <br />~ <br />Land or Tenant <br />Lease Agreement -18 <br />
