14. Eminent Domain. <br />If a condemning authority takes title by eminent domain or by agreement in <br />lieu thereof to the entire Building or a portion sufficient to render the Leased <br />Premises unsuitable for Tenant's use, then either party may elect to terminate <br />this lease effective on the date that possession is taken by the condemning <br />authority. Rent shall be reduced for the remainder of the term in an amount <br />proportionate to the reduction in area of the Leased Premises caused by the <br />taking. All condemnation proceeds shall belong to Landlord, and Tenant <br />shall have no claim against Landlord or the condemnation award because of <br />the taking. <br />15. Tenant's Default. <br />15.1 Default.. <br />In the event of any default 6y Tenant under this Lease, Landlord shall <br />be entitled to any remedy now or hereafter available to Landlord under <br />the laws or judicial decisions of the state, in which the Leased <br />Premises are located. Termination of this Lease shall not relieve <br />either party hereunder from any claims for damages resulting from any <br />breach of its obligations hereunder. <br />15.2 Leaal Expenses. <br />If either party is required to bring or maintain any action (including <br />assertion of any counterclaim or cross-claim, or claim in a proceeding <br />in bankruptcy, receivership or any other proceeding instituted by a <br />party hereto or by others), or otherwise refers this Lease to an <br />attorney for ffie enforcement of any of the covenants, terms or <br />conditions of this Lease, the prevailing party in such action shall, in <br />addition to all other payments required H~rein, receive from the other <br />all the costs incurred by the prevailing party including reasonable <br />attorneys' fees which the prevailing party incurred on any appeal. <br />16.
