with fifteen (15) days notice to Tenant, unless Landlord deems entry <br />necessary without notice due to an emergency. <br />10.4 Services. <br />Lessee shall pay all charges for electricity, gas, water, heat, sewer <br />use and all other utilities and services used in the premises during the <br />term of this lease and agrees that if default is made, Lessor may elect <br />to pay any such charges and any such payments by Lessor shall <br />become immediately due and payable by Lessee to Lessor. <br />10.5 Landlord's Duties. <br />Landlord stiall not be in default under this Lease or liable for any <br />damages resulting from or incidental to, nor shall it be an actual or <br />constructive eviction of the Tenant, nor shall the rent be abated by <br />reason of: <br />(a) The,interruption of use of any equipment in connection with the <br />furnishing of any of the services described in this Section 10; <br />(b) Failure to fumish or delay in furnishing any such services when <br />such failure or delay is caused by accident or any condition <br />beyond the reasonable control of Landlord, including the <br />making of necessary repairs or improvements to the Leased <br />Premises or to the Building; <br />(c) Any limitation, curtailment, rationing or restrictions on the use <br />of electricity, water, gas or any other form of energy serving the <br />Leased Premises or the Building; or <br />(d) Failure to make any repair or to, perform any maintenance, <br />unless such failure shall persist for an unreasonable time after <br />written notice of the need for such repair or maintenance is <br />given to Landlord by Tenant.
